How about a guarantee that a game will work for 5 years? If it's shutdown earlier, a pro-rated refund is required? I kind of agree that some games probably can't go forever but we deserve some reasonable assurances.
I'm conflicted as they are not literally the same but it is a blatant copy in every aspect and intended only done to confuse consumers into buying the copy. I don't like the suggestion Nintendo is being negligent by not just taking the dev at face value, slap a warning on the store while investigating.

Video games are luxury products and will cater to people who can pay for them, if it is profitable to accommodate people companies will do it.
With that said button mapping feel like very minimal effort and Nintendo is backwards on various fronts.
