Re: Random: Well, Here's A Crazy New Theory About Mario's Origins

zidentia

@Cool_Squirtle Unless you use the actual photograph there is no chance for litigation as the image of a blue collar worker whether it is a carpenter or a plumber is not an image you can copyright.

He could have been influenced by this but by his own recounting there does not appear to be an conscious effect so it does not matter.

Re: Is Your Copy Of Super Mario 3D All-Stars Crashing? That's Because You've Got A Modded Switch

zidentia

@sj33
First off I applaud you for stating you "mod" your Switch as opposed to Hack. Drives me insane that people think otherwise.

As far as the EULA the argument you have is technically right but not viable in court every time. There are numerous cases deciding either way whether you can legally agree to an agreement without signing or verbally stating so. Versions of EULA's have been used in other industries to great advantage effectively quelling any dissent on behalf of the consumer and this is the precedent normally cited by the video game industry. The problem is the entanglement of the creator/owners IP rights in conjunction with an outdated DRM policy.

I for one, being in the industry mind you, feel EULA's are crap. Also the right to repair/physical ownership movement is in the right because there is no legislation that explicitly states you are leasing/renting a piece of hardware when you make a purchase and agree to relinquish those rights. Here again we have outdated laws and policies that have been reinterpreted to create an over reach in response to theft/piracy of IP and likeness which in it's ignorance harm the ones that actually make the purchase.

Piracy is a different matter for me. I and many of the companies I contracted with have been hurt by piracy. What people do not realize that the developers and designers actually get hit harder than the companies in many cases. On my own I have had my stuff pirated but I try not to worry about it. If a game is out of production I think we need a more uniform way of preserving it for the future so it is legal(to protect the user actually) and costs minimal. There are so many titles that have disappeared and the real problem now is the rights holders have changed so many times and companies sold, bankrupted or licensed out that untangling them is not feasible. I have no answer for that situation but most likely you could still preserve these games for a nominal fee without legal actions being taken.

@BanjoPickles
Your list has a lot of great title. Some of the ones I liked were:

Professor Layton and the case of the Curious Village
Ninja Gaiden Dragon Sword
The Legend Of Zelda Phantom Hourglass
Call of Duty 4
Brothers in arms
Lionel On Track
Prince of Persia
Super Mario Bros 2 GBA games

I have the memory expansion and the web browser as well.

@BanjoPickles
My thoughts exactly. The DS Lite is still likely my favorite handheld/ great battery life, a really deep catalog and true portability with a built in screen protector. I still use mine. I almost pulled the trigger on the 3DS but the titles were thin in the beginning then stock was in short supply.

Re: Surprise! Nintendo Says Its Next Console Is Going To Be Very Much Like Its Other Consoles

The Switch is basically in the middle of its life cycle. As Nintendo themselves have mentioned they anticipate a six year refresh cycle. This gives them time to fully flesh out the next hardware. What people are totally missing out on in these "rumors" is that even if they are true the timeframe is really long for testing, mfg samples and software work. It is likely 2022/3 for a new model.

Re: EA Is Considering Bringing EA Play And "More Great Experiences" To Switch

zidentia

EA is a perfect example of what happens to a great company with a lot of success that moves strictly corporate people into positions of financial influence. Activision was a great company and we did a lot of work with them but as the years passed they changed as well. Sierra was great until they sold it off and then it was destroyed. Its what happens.

Re: Here's Your First Look At The Console Wars TV Series From Seth Rogan And Evan Goldberg

zidentia

I had hope for High Score but for me it was too light on real substance. They spent way too much time not fleshing out the participants and repeating information to fill time. Then it spent a lot of time on diversity which is great but seems too political when you just want real details.

Part of the problem for me may be that I know everything intimately already but I was hoping for things to come out that I had forgotten or to see people form the past. This latest attempt may be better as along as Seth Rogan is not in it.

Re: Sega Says It Wants To Re-Release More Past Titles On Nintendo Switch

zidentia

Ah Sega. Still making those ridiculous decisions even after NA told you what would work in the west. Nothing has really changed as you always get in your own way. I personally am a huge fan of Sega and went with the Genesis over the SNES because the games were so much better initially like SOR but I came back to Nintendo because Sega left the market after the horrifying Sega 32X/Saturn kerfuffle.

There are so many games you could port and if you advertised a bit your fans would come back. I would like to see M2 do the emulation as they do a good job but somewhere in a cubicle someone is getting ready to make another bad choice.

Re: Feature: Keeping It Physical In A Digital Age

zidentia

I am still primarily a physical game player. On the Switch I have one of the largest physical collections I have had outside of possibly the NES. I do have digital games because some things cannot be had on physical media but these are stand alone older games with no live connection needed to validate. I have been burned by digital storefronts and I say no thank you to Steam and the like. If I want it forever I try to buy digital.
