@marck13 It depends - they could be in trouble if they've breached an NDA, but their products aren't licensed anyway so that's unlikely.

It's a non-functional model, but there could still be some patent breaches depending how accurate a copy it is. Even then, Nintendo would have to be able to demonstrate a loss and be able to get an enforceable remedy.

@GrailUK I'm normally against this kind of thing, but they used an existing mod (without which the game is an unfinished mess) to promote sales of the game. If they had been silent on compatibility or said it wouldn't be compatible, they would have sold fewer copies of the game.

On top of that, they refused to give refunds and offered keys that would increase user count in their other titles.

Whichever way you cut it, the advertising was misleading.

I installed it on my Surface Pro back on the day and couldn't get it running at anything like playable frame rates at a reasonable resolution. For a game that isn't remotely impressive visually, it's surprisingly fussy about the hardware it'll run on.

I suspect it's so badly optimised that it just wasn't worth the trouble of getting it running on consoles. The PS5 would have enough muscle for it, but I can't see it selling now.
