@Stocksy I did not mean to necessarily blame the EU. I said these appear to be Nintendo's reaction to new EU regulations.

Given the status of these systems, it probably did not make sense for Nintendo to upgrade the systems to accept credit cards directly and meet the new payment safeguard regulations. There are still ways to purchase games. It just the payment options are more limited.

@roadrunner343 I expressed that very poorly.

The console to which I compared it (the Atari Flashback portable) has 60-70-80 (depending upon the version) of games built-in (which I meant when I said loaded) — and they are licensed.

My thought was that if there were no licensed games included and it could not play original hardware (like a clone system), it really is not much different than a copy cart (like an R4) to place in an original system.

I agreed that the use of others' IP without a license that causes the real trouble. The issue is whether a complainant can show that there is no real legal use for the item. (We know about the non-legality of running most ROMs.)

Here is a key point: Correction: This story originally said that WarioWare gold launched July 27. It actually debuted in North America on August 3. That gave it two days of sales on the July NPD chart.

The writer had the NA release date wrong. So I wonder if he thought it didn't chart in 9 days — which would be a much larger story.

One point that is missed (or at least I have not seen) is that this refers to actions from about 15 years ago.

[The first game was released almost 13 years ago on PS2 in Japan.]

That was three Nintendo consoles and just shortly after Iwata took over as head of the company.

It was a very different world. The way the headline reads, it sounds as if this was a recent development. It was not.

This is one I had no interest in ... until I played the demo.

Now my question is Switch, 3DS — or both.

The only problem I had with the demo is that if I pressed the screen too hard, I could not link plates. I had to use less pressure to be able to make matches. (And no, I wasn't trying to press the TV screen).

I would think that Nintendo has shared information, even if it is just at an abstract level, with its prominent retail partners. And while there are plenty of reasons to not be critical of Gamestop as a corporate entity, it is one of those partners. It is also interesting that store clerks at its stores that talked down the WiiU and even the Wii are now enthralled by the Switch and are even pushing it.

@JTMnM I use the same tools. But it is tough when you are off Twitter for the evening and an exclusive item releases and sells out within two hours.

This is also a bit of a cautionary tale as had I been able to order the amiibo, I would have certainly bought the game. Now I am not so sure.
