Actually this is exactly my reason for getting it too. Super stable 3D, menu advancement, faster computer and download. Exclusives don't matter 'that' much, but it feels good knowing I get SNES games now. Funny enough, the kisekae plates made me wait in NA and I still don't have any other plates yet - still wanted the option though.

First, I would like to apologize for taking several days to respond. I have been slightly busy with work, however I was quite eager to respond to your comment as well.

You start with my list and responding to it which is something I appreciate greatly. Your responses are below.

1 and 2) Video Game Systems can and actually have to afford the wait for finalizing development different than TV or Tablets though. If I was designing a TV, when new tech came out that I wanted to consider, I could easily just add it to the next design that will be out by the next Holiday Season. The lack of that tech for a year isnt going to drastically hurt my sales and the inclusion within a year is nothing as I would also have additional development time to make sure it works perfectly. For Video Game Systems, not only Nintendo but also XBox and PlayStation, the gaps between release is usually Minimum of 5 years. Technology Drastically changes in that time. Especially development costs.
Consider if a screen on a handheld could have been made slightly different. Like the 2DS. It actually is an entire touch pad screen that is covered and imitates two screens. Reasoning for this is of course cost. While the idea, utilizing one screen, could be considered the concept to reduce costs, this could also become pricey down the road if the screen has a flaw and constantly requires fixing. This cost would be not only in the $ to fix but also the negative impact of the ease of breaking it. Additionally, there is the possibility that there would become a new way to design the touch pad screens. If Nintendo starts making one screen in mass production and another comes out with a decrease in cost but no reduction in ability Nintendo cannot easily switch the screens without making a new version. You wouldnt want Nintendo releasing two different types as the same thing without considering that there would be a minimum TWO ways the screens could fail. Additionally, if a screen failed, the public would then be worried that ''their personal handheld'' is the one flawed and therefor Nintendo should fix it before it breaks.
All the above is of course just a conceptual idea I made up just now, but it does, at least I hope, show how such a little concept could quickly become a headache to manage right before a system launch. The 2DS is actually not even that dominate in the sale focus and doesnt have a 5+ year development to hold over either. If new tech was available that could be considered for the next system, not only can Nintendo delay their system, but they SHOULD pending a quick consideration for the potential of this tech. Imagine if the next bit of tech can be as important to this "NX" as the Motion Controls were for the Wii. Or the Touch Screen for the DS. Missing out on this tech for that entire system could potentially break any chance this system has.

3) To be completely honest, I cannot remember if Nintendo ever actually gave themselves a constraint on when the "NX" would be released. I remember last March (2015) they mentioned that the next Video Game system (not Console or Handheld, just the system itself) is already in development and wouldnt have more information released until 2016. This type of language doesnt restrain the release window at all. It is like Sony saying that the PS5 is a thing. We pretty much know this is true. The problem is that EVERYONE seems to think that the "NX" HAS to be released no later than 2016 because the Wii U is failing. Not "Has Failed", Is Failing. I say that because it is STILL getting worse with time. The problem with this consideration is that Nintendo DOESNT have to release the next system this year. In fact, Nintendo could stupidly decide to wait until 2018 or even 2020. This is HIGHLY unlikely, but then again it is Nintendo.

With the fact that the release isnt set in stone, if (in reference to the 1 and 2 answer above) another new tech has recently been developed, Nintendo should consider every new piece to see its potential and if it would be cost feasible. With regards, however, Nintendo should have mentioned that the "NX" was coming. As they did. At the time a year ago, the Wii U was suffering (as now ) and Nintendo was CONSTANTLY being hounded, even by Board Members, to make "Mario on iPhone". "Go Mobile" is something that A LOT of Japanese companies have shifted towards and many of them are truly suffering horribly from it. Konami, Capcom, and SquarEnix have all gone that way and while there are some successes that make it to the media, MANY fail because of the higher costs to develop (which doesnt meet the "$1 games, or Freemium" concept eye-to-eye). Additionally many gamers feel slighted because their next expected Megaman or Final Fantasy release is another re-release onto a phone with sub-par controls. Nintendo easily assured many of their fans that this wasnt the focus of Nintendo. Not with the announcement of "New titles designed for the (phone) system", but by ensuring the development of a new system.

Additionally, the announcement of the system drastically affected media exposure for the last year and even further in the future than today. Without that announcement (or another announcement saying the "NX" is being developed), we would currently be discussing the possible end of Nintendo as a "1st party" developer, as the end of "Good Mario, Zelda, Kirby, Smash Bros." games, We would heavily be discussing the possibility of "Mario on PS, Zelda #32 on the XBone". Those seem FAR worse than the extremely premature announcement of the "NX". In fact, the "NX" announcement has called into play a lot ''less'' conspiracy flames from the tin foil hat crowd. Tin Foil people, after all, tend to grow in number without being fed random things. Giving them a focus, this "NX", allows Nintendo to keep things better in organization. Consider this same concept in politics. Often, people going for an office will "leak" somehow a story that gets everyone into a frenzy. In the mean time, they can focus the media on that while they take care of other problems that will have a negative spin no matter what they do. It was the right call, in my opinion, for Nintendo to redirect media (and Tinfoil People) towards the next system rather than the bemoaning of the end of Nintendo because of Mobile gaming.

P.S. I hope I didnt ramble on too much. I really enjoy others giving their opinions and sharing my own. I tend to over explain at times, however I tried to cut it back a bit. I actually didnt take your comment as aggressive but seeing that message at the bottom made me quite eager to respond. It made you seem much likely to consider my comment more rather than a tl;dr response. Thanks.

You have some good points but I think you missed my major focus. First physical games must always work. If the game is officially licensed it must always work on different versions of that same system. Digital games can have their license revoked and therefore every copy of that game digitally copied. Physical copies cannot be prevented and no patches can be made to stop physical games from being played. Additionally, you physically own the game and therefore have the right to sell the game. Digital copies cannot be sold because you do not own them.

Again regarding the first part, you will always be able to play a physical game. Digital copies can be Bricked by the companies involved, so no. You may not always be able to play the digital game that you yourself brought.

Would you really be the petulant child that would throw stones if they delayed the system? I can easily think of three reasons why that would not be a bad idea. Just off the top of my head:

1 - New technology shown to Nintendo can be added to the new system with a slight delay, new technology such as a way to easily implement fan-requests like CrossBuy.

2 - New technological advances show ways of making the device in a cheaper format and therefor justify the delay to explore the advancement for durability and productivity.

3 - Possible continued advancement of games on Wii U would also play a factor on the "end" of the Wii U. If, for example (not something I think will actually happen, mind you chat) Zelda U had a major issue that pushed its release back from Sometime 2016 into March 2017, Nintendo would be foolish to release the NX Device earlier than the game. Which would encourage a delay of the system as well. (this being, regardless if Zelda U is a Wii U/NX release, or just a Wii U release. Either way, releasing the NX earlier would be a mistake.)

There are a lot of other factors that must be considered. In addition, Nintendo only informed the world about the NX system in development because of the Mobile Gaming announcement with DeNA. If they didnt confirm such, we would have had over a year of people making "Nintendo is DOOOOOOOMED" announcements and then the NX would just be described as a means to counter that overreaction. They most certainly showed info about the current Codename: Nintendo NX to quite soundly make apparent that they are not leaving the console systems anytime soon. Not that they were rushing the end of the Wii U.

I am certain that this is just the pre-order bonus for Splatoon when you bought from Target. I know it was active at least in the USA. I would have considered getting it from Target but they alway sscrew up the pre-order bonus. Target instead of giving these with games, sold these for $5 each.

And if these are the same quality as the Splatoon release ones, they are not even worth a buck unless you want it for the novelty. It was extremely poor quality and I doubt that it would last even an hour.

It isn't exactly the same. If I buy a physical game, I own the game. If I have to download part of the game to the system, I still physically own the game. If they update their system to prevent me from playing, I can get a different system and still play the game.

Digital only is different. If the company feels I'm in violation of one of their policies, they could break my system. They could disable my ability to download that game. They could disable all online content.

Basically, the company is ensuring that they can punish people when people buy digital. I believe the laws of different countries dictate physical games can not have such restrictions.

How I managed to contact SE for requests to localize DQVII was silly. I had to call up the FFXIV Support Desk and get transferred about a dozen times until I got to the people I needed to talk to. But I was able to talk to them

Biggest problem I see often is Nintendo fans jumping the gun on information. I feel as if it is a problem with feeling inadequate compared to Sony or Microsoft because their install base is bigger and they tend to get more 3rd party support. Then Nintendo fans "deserve" and "demand" more and immediately expect things to be screwed up because... you know, "Nintendo".

I always expect not the best, but not the worst. Nintendo rarely screws up a lot and they would have extra motivation to get things right with the next system. If we, the fans, make it apparent that we dislike and disapprove of Digital-only, the My Nintendo will fail without alteration. And why would Nintendo not alter it if it is failing as well?

We just have to work together at being fans. Not ridiculing things that are not even announced. People were saying for THREE YEARS that Dragon Quest VII wasnt coming State-side (or to Europe at all, as they never got the first PS release *Congrats Guys *) All I did was say SE didnt say "no", and I wrote them constantly to consider it. So to add to the news from the direct. You can have up to 8 keys per level. You can have multiple keys at the same time. Maximum of 5 key coins per level. Advanced research on your own levels: Where the people die and see their comments.

And did they already say there was 12 new amiibo costumes? I don't remember if they gave us a set number.

Is anyone else honestly and truthfully upset that people still keep bringing up slopes like it is the one thing that failed this game?

I would MUCH rather them add a bunch of other things. I even made up a list of things I would like.

Win conditions:
Collect Star Coins (passable with the Key Coins)
Key and Lock (passable with Key Doors)
Must defeat boss. (boss can drop Keys)
Collect 100 coins possibly with a Green Star Block SMW style

Themes: (DLC maybe? for creation tools I mean)
Desert
Beach (water placeable)
Snow

How about a way to link up several levels online?

It is just upsetting that all I ever see is 50% of chat saying SLOPES!!!11111!

That was a completely separate matter. The company was making money off of their actions, unsolicited from the Pokemon company and well more than minor amounts to set up the event. The concerning part about this is that the people are already paying licensing fees meaning that the Pokemon company had previously allowed this and did not approach them but rather just went to youtube claiming that they were making illegal content.

I actually didnt see a problem with the Tears of Light Mini-Missions. They got me involved in searching every little nook and cranny in the areas and it was very exciting to see the difference between the world I learned (bathed in Twilight) and the Light World differences (the color and vibrant scenery) when the area was rescued.

Additionally, the Tears mini-missions were a very small part of the game. The Triforce Hunt in WW was a large aspect of the game that dragged on much further than it should have and when combined with the Slow Sail it bacame overwhelming. Definitely something that should have (and was) improved in the HD. But these Tears? Nah. If anything, I would say they should speed up the intro a little, make it into the first temple about in half the time. And that would do. Add a Hero Mode and maybe another collect all the X and I think the game would be fine. Add in the amiibo interaction (even if it becomes the Collect all the X) and I am quite pleased with this mock-up I created in my head.

It took me a while, but I finally remembered the single part of the Tears mini-missions that bothered me.

@ThomasBW84 and @MitchVogel What do you think about the idea that the 4 missing Tears are actually just the Tears during the hard Flight Tunnel just being removed? I recall them as being the hardest Tears to collect and coincidentally there were exactly four in the tunnel...

I agree with this sentiment. Cloud was the best part of the three and Nintendo spoiled it last month. However, I dont think either of the other two would have been good for the Nov Direct. Corrin would have been far out of place, Bayonetta was the Ballet Winner and would have dropped hype for this direct. Really, I wish more that the costumes were dropped in Nov. instead.
More for Cloud though, the fact that SE agreed to DQVII and DQVIII would have meant that Cloud should also be included with those announcements. So I dont think there was much else they could have announced in Nov. and without Cloud in that it would have been lacking I feel.

Honestly I find all these awards to be insulting. I can almost never say that I agree with any of the winners because the results always seems like a popularity contest rather than the GOTY because of effort. I figure that Fallout 4 is going to win simply because it is so recent and because it was requested for a long time.

Even further, I think that Half-Life 3 would be handed the award if it comes out (sometime) and that next year is already lost with Final Fantasy VII getting a remake. And PushSquare seems almost certain that the winner is either Fallout or Witcher 3.

While there are trolls that like glitches like this, there are also most speedrunners liking glitches. Some of them go out of their way to keep pre-patch versions to keep the ability to challenge the world records.

There are also glitches that are just fun to see and do. Those are ones I like to see.

I would not mind paying for unlocks for the creation area of Mario Maker. Such as if they added Desert theme and say Pokey, Angry Sun, Fire Snakes, Fire Bros. (or additional add-on to Hammer Bros by adding Fire Flower), Cobral/Triclyde, Phantom Masks, and Block Goomba.

I could easily see Nintendo asking for as much as $4.99 (USD) for that, and while I would think above $3 may get grumbles, I think for the ability to use them in every variation would be worth it.

For the Course World, I would really hate them to prevent non-purchasers from obtaining the levels with paid DLC involved, but additional modes or editable rules for levels is something that I could also see. Like a way to rate other people's levels would be cool, but maybe not paid. But the ability to link up to 16 levels into a "game" would be something I would pay for.

EDIT: Most certainly I would like to see more Bosses or methods of setting up "drops" for if an enemy is defeated to force battles.

I actually think it's a little sad that they are breaking the exclusives when they explicitly said they wouldnt. If they're planning on having that expire, they could have made an official announcement like exclusive expire after 6 months. Instead they had Best Buy get THREE amiibo that are exclusive to others and TRU has Shulk too. This feels very anti-GameStop and I feel GS will retaliate just before Christmas.

Sad to say, but I found that most of the GB games I wanted were either out already or Dragon Warrior/Dragon Quest games. And with the way Squarenix acts, I never expected anything of that.

The bigger loss, in my mind, is the lack of the GBC games, the COMPLETE lack of GBA games, and the COMPLETE lack of SNES games. Honestly, I DONT WANT portable GBA and DS games on my Wii U. I would rather have them on a portable system. Isnt that what Japan is like too?

I find it sickening that your response is to say "You're so messed up lol". That exact apathetic and lackadaisical attitude is why this guy is in trouble in the first place.

Looking over these comments, I realized something. A great way to examine this situation:

Consider us all "fans" of Nintendo (and/or TPC for this discussion). Half of us sees nothing wrong with what this guy did. The other half feel as though this guy isnt a fan of TPC at all and instead used it for his own benefits. And Half the fans here seem to think that perfectly acceptable.

Let us look at this a different way. What if we are fans of Lions. You know, the Big Cats. We all get to enjoy these lions by going to the zoo. We pay for a ticket to see the lions. But then you get our boy Ramar Larkin Jones and he thinks that a lion will draw business to his cafe. So he steals it and declaws it to make it "safe" to display. And then the zoo finds out. And half our group wants to support him on this? What if he KILLED that lion and got it stuffed? You know, to make it easier to display. Would half our group still think it is alright?

I am sure that many of you will look at this contrived story as out of the blue and not related, but it is. Ramar Larkin Jones STOLE something that at least a majority of us likes a lot. He DAMAGED the thing by showing in a public space that same thing crossed with alcohol. With a paid entry to some cafe. With the poor conduct that he is displaying now. How is his actions against Pokemon, the IP and story instead of TPC, any different than declawing and showing off a lion or killing it to stuff it and show how much a "fan" he is?

This guy is a criminal. Just as bad as the pirates that steal the games themselves. Only difference is that he is selling it too. At least the pirates usually drop them off online for free.

And for the sake of my sanity, everyone PLEASE stop saying it is over the poster. The poster was ONE of the things that drew attention to the illegal activity. It WASNT the entire illegal activity. If the poster wasnt made, his actions were still illegal. Nintendo/TPC just might not have seen his actions.

I appreciate that link that you supplied (Post #51). It did help clarify a lot of things for me. But one major thing it made me thing is why are images not covered by Trademark then? I thought images were under Trademark like names, but that isnt part of this discussion.

Instead, the bottom of that link has incredibly useful information under "Myth #11". It says that Copyright cannot be lost, as AceDefective mentioned to me, however legal action is a good idea. As we most certainly do not know the entire story, a C&D might not have been enough in this case.

My reasoning behind the $4000 lawsuit is still the same. I feel as though TPC is completely in the right here.

I thought Copyrights worked the same way? Regardless, going "nuclear" as you seem to keep repeating would be demanding the full value of the Pokemon IP.

I doubt they asked for that. Instead, it sounds as if they settled for a mere $1000 per year of the theft. That sounds reasonable to me. If the demand is within a certain amount of time, there is still the fact that TPC is being generous with such a paltry sum for the theft.

And this guy most certainly went and threw TPC's name in the mud which causes me to feel this further problem is also of his creation.

You seem to misunderstand the legal requirements of owning a Copyright.

If he did not use the poster, he still would have been in violation. It was the poster that eventually drew TPC's attention. The word "Pokemon" was even in the title of the event.

Copyright Law dictates that the owner must defend their Copyright in cases like this. Usually a C&D is enough. Perhaps that wasnt enough in this case where the guy already did multiple events in the past and didnt get a C&D or charges.

The reason why Copyright laws are built this way is so that Monopolies can be created and destroyed. IF you defend your Copyright correctly, including suing and C&D where needed, you can protect it. IF YOU DONT, you could have other groups do this exact same "minor" events. Then companies like GameStop could host these events because "other people could, why can't we?". Then you have Microsoft (or another major company) say "If GS can do this, then why can't we?" And suddenly, the IP Copywright is lost.

TPC may HAVE to sue to protect their IP.

In any case, this is something that TPC objected to. TPC also has the right to sue over damages. If this guy hosted this party and used Pokemon in the name and advertisements, it is easy to assume that TPC is backing it. Even further, he did it for 5 years. Add in the charge at the door (regardless of the usage, the money wasnt the customers paying the DJ, It was the Cafe owner), the alcohol at the event, and other non-pokemon "kid" friendly activities, and this guy was asking for a C&D. AND for those saying the $4000 is too much in addition, well maybe it was $1000 per year of him doing this. By the sound of it, he said that he made "only $60". If that was per year, I doubt the Door Charge was able to pay the DJ and prizes. Maybe he misspoke, but if it was that he made $60 total, at $2 entry, that would only be 30 people and it was "filled to capacity" as he mentioned (at least about the party, which I think he meant about a previous year). I seriously doubt only 30 people participated combined over the last 4~5 events.

I see this exactly as if he was bad mouthing The Pokemon Company. He STOLE the IP. Regardless of the usage. He then Charged for access to the event that he themed around that IP. Then he gets stopped, after 5 YEARS of this, and gets sued. Then complains about it online to get other people to pay for him. It is disgusting that people seem to think this was an acceptable use of The Pokemon Companys property.

Honestly I would be a bit upset if this was all I got. If I got charged two or three times this would be acceptable, but I would expect more for the people charged seven or more times. And that isn't even saying the overdraft fees I expect were paid.

I would say a £10 gift card per additional charge, but I may be a bit excessive here. Another problem is that the game came out 21 days ago. Did they send that through the slowest mail possible? It feels like an additional insult to bring it up again by now, then again are all the charges reverted and fees paid?

I don't know GAME (I live in the US), but didn't they offer a reduction on Splatoon for those who were affected? That problem wasn't entirely their fault.
