Nintendo and Sony aren't financially involved in the production of the game, nor did they sign a contract to have it brought to their device, therefore Microsoft aren't legally obligated to sell the game on their devices. A blind man and his dog could see that any chance of the game being multiplatform went out the window as soon as Microsoft bought the game.

But I can stick with the games I'm playing rather than flit between them all because I can't decide what to play.

I can't speak for the EU, but here in Australia electrical goods are expected to last for a certain period of time depending on price and type of appliance. Warranties mean nothing if the product becomes defective in an unreasonable time frame.

If I send my Joycons to Nintendo for drift repair and they refuse to do it for free, I can go to the ACCC with my issue (and present this complaint from BEUC as supporting evidence) and they'll tell Nintendo that there is a problem with their product and they either have to repair it, replace it, or give me a refund. Consumer protection is why Steam now offers refunds.
