@FantasiaWHT For the US that might be true. In Australia consumer protection laws exist. If a product breaks down sooner than it would reasonably be expected (regardless of manufacturer warranty) then the company is obligated to either, repair it, replace it or refund it. We recalled 20 year old air bags because there was a manufacturers defect.
@eSocrates Yeah it's not exactly the original hardware that they're running their virtual console on. Also look at virtual machines, they're emulating operating systems and is a whole business model for certain companies. "Good" or "bad," emulators aren't going anywhere.
"And then, of course, there's the ability to sell us last-gen games all over again! Hey, it worked for this gen with Wii U games, and Sony did nicely milking The Last of Us three times in nine years, so why not again?" Ladies and gentlemen, welcome to the introductory course of "Being a shill."
@Zach777 None of of what you said negates what I've said: They shouldn't have released an obviously flawed product. It's inexcusable. It's not a mistake, it's negligence.
@Zach777 Difference being that NinjaNicky isn't trying to sell what they have written, customers are well within their right to expect a quality product. Considering the money Pokemon makes from games, cards and merchandise, they can afford to do decent quality control
@BlueBeemer "So it's forgery/counterfeiting which is also illegal." Nah, a forgery or counterfeit would be trying to pass it off as the original, like the fake pokemon carts
@Tober Except they are part of the same country, they are all bound by the same federal laws, they are all part of the same society and some parts of it have wildly different beliefs than the other. So no they aren't different societies. So it does boil down to one having an ethical view, and one not. I'm not denying it's oppression and I'm not equating it to piracy, though I'm sure some around here would say piracy was oppressing Nintendo. The fact is that they are in control and can set the laws, and you cannot deny that some of those laws are unethical which contradicts your statement.
@Tober Except there's rarely, if ever, consensus among all people. Take the U.S for example (because they're always great for presenting the extreme). Abortion is illegal in some states but not others. One of these laws is more ethical than the other but there is no consensus. Defining which one is moral automatically makes the other immoral, therefore we have an immoral law. Then there are dictators that enforce their own desires as law, usually to the detriment of the majority of the country's population. Won't even go into the number of elected politicians that serve their own best interests (most) rather than the interests of the people. So, no, not a contradiction.
I pirate old games. Is it illegal? Sure. Is it unethical? Not if it's not available for purchase any more. There are things that are illegal which shouldn't be, and things that are legal which really shouldn't. Pirating a game that hasn't been commercially available for 10+ years shouldn't be. Want to make money off it? Keep selling it then. Otherwise make it clear it's unsupported and any security issues that arise from using old software are solely on the user.
@Cashews " Can you not download any game you purchased, right now, on the eshop? spoiler alert: you did and you can."
Not on the Wii you can't. Whether or not you've had access in the past, it's still a denial of access now. The 3DS and Wii U eshop will soon be in the same position despite the fact they are now overcharging people to maintain their awful online infrastructure with their online pass.
@Switch_Pro Except it's not in the eye of the beholder. Fair use clauses in the copyright act allow people to produce this sort of content; journalistic pieces. If you're not willing to concede the point then I won't discuss this further. Considering NintendoLife produce similar sort of content, then you should be operating under the premise that Nintendo will be issuing a takedown notice for the site.
Or.... they are rivals, and that's good because without competition neither is encouraged to improve. And the build quality of the switch does need to improve.
@CielloArc @Switch_Pro @sanderev @Bustacap Except if noone involved in the making of the video was a part of the NDA, then they didn't break any contract and are instead reporting on information that was available to them and should be free to do so.
@nin10doom "If you're confused, maybe shoot them an email and see what their stance is." Their stance, what's legal, and what's ethical are three completely different things.
@SwitchForce Who's backtracking? I've stuck to this stance from the get go. I didn't sign anything when I purchased the product. Saying I have to follow a contract I wasn't provided with (or even made aware of) before I purchased the device wouldn't hold up in any reasonable court of law. The fact I hit "I agree" to any ToS when I powered on the switch is irrelevant, the entire contract is invalid.
@Piyo Nah, making the games available for a price is piracy. Doing it for free is necessary to ensure that the file gets distributed enough to remain preserved.
@KateGray Nah, that's only the start, these are some of the other things needed: Permadeath Turn-based Item functions randomised between runs and you don't know what they do until identified or used (red potion heals one run, causes invisibility the next)
Usually people call a game a roguelike if it has permadeath or randomised dungeons, but that's like calling Super Mario Brothers a third person shooter because Mario can throw fireballs. I recommend checking out some Angband, ADOM or Nethack (or Rogue, the namesake) gameplay for and see the contrast in gameplay between them and Roundguard (or Hades, or Binding of Isaac).
@SmaggTheSmug Let's be fair, Oblivion and Skyrim were buggy messes too. And Daggerfall. Fallout 3 too. New Vegas as well. Fallout 4 needs a lot of patching.

Exactly it. The number of these pieces will vary based on the size of the set and the number of small pieces in the set

Haha, considering the types this site attracts I wasn't sure if you were serious or not until the third paragraph.

I'm calling it what it really is, Nintendo threatening to bankrupt individuals if they don't comply with their desires.

"Like nobody barely brought it." So lots of people bought it.
Isn't this what Switch online is supposed to be? Paying to keep their online servers alive?
