I do believe that names cannot be copywritten though, maybe trademarked yes. (This is most true for book titles with generic words. You can copyright the entire work, but not the title. So the title "A Night in Paris" cannot be copywritten, even by the author of the most popular search result.)
And here my stance gets a bit murky. Since it is a name (or title?) then it makes sense for Dream Alone to spell Lady Death with capital letters. If (hopefully) she isn't a copy or similar immitation of Mr. Pulido's work, then they can be considered two different concepts and distinct, despite sharing an (admittedly) general name.
Would be a shame if heroes with names like The Mistress of Death (and variations) or (god forbid) "Death" become famous and copywritten and we writers all can't use those terms anymore. (The latter of which is actually a Marvel character)
EDIT: I forgot to add my main point haha. You can copyright the Character, but copyrighting the name is another matter (like Thor). As Lady Death here is (hopefully) dissimilar enough to the more famous Lady Death from comics, it should be OK to use the name. The fan fallout and search difficulty is wholly different though.
We're really enjoying this game at the office so far. But the controls are clunky and unresponsive, with noticeable delay. It's quite frustrating. If the story weren't so intriguing, we might have stopped playing altogether. But alas, Sehwa High has us in its grasp...

Still, it was a great game and I highly highly recommend it if you are a fan of Southpark's humor. The gameplay is also decent enough to stand on its own, and offers more customization than Stick of Truth's system.

It can be the same as being called "The Animal Name" or "Captain Adjective", although having the same name as something more famous does hurt your brand recall (and web search returns). Imagine a children's story character being named the same as a porn star, for example. A student of mine suffered that fate, unfortunately. (And she came up with the character name before the porn actress did!)
Legally, it's also more difficult to copyright the name (like apple). Much easier to copyright and protect the likeness and combination of powers of Mr. Pulido's work, though.
If this game's Lady Death is drawn differently and has different powers, I think they're in the clear.
That's why other writers typically make words up, to make them easier to copyright. A combination of words is the common technique (see Lady Stoneheart)
@ThanosReXXX not sure if it's just poorly optimized, but my 5-year old i7 laptop (the same one that ran Stick of Truth with no problems) struggled to run this game. Was forced to install it on my newer desktop.
I hope the Switch version runs better, as this is a fantastic and hilarious game.
Also, just want to point out that the article could use more proofreading. "On-scree" and protagonists instead of protagonist's are only a couple of issues with the article.

The bigger issue here is the content part. Like what others have mentioned here, developers are struggling to create 4K games that also run at 60FPS. There are a few, of course. Mostly AAA games whose main selling point is graphics. But there are plenty of games that don't need 4K. Heck, many games don't even output at 1080p optimally. So until developers make 4K their standard, there isn't much incentive to jump up just yet.
@mikegamer honestly I think even the "butthurt graphics fanboys" see Nintendo's point. 🤣 4K will have its time, just not now that 1080p is already more than enough for 99% of games out there. No point in demanding 8-bit and cartoon inspired games be viewable at 4k anyway.

My phone has the capability to render 4K resolution, but almost none of the apps (and movies on my device) are 4K, so it's a relatively useless function on my phone.
At the moment, 4K is an expensive gimmick for tech-hungry people (both gamers and developers). I'm sure down the line it'll be cheaper and standard, and only then will it be worth investing in for Nintendo.
Sucks for players of Pokemon Go. I only change phones every 4 or 5 years, (went from a Note 3 to a Note 8) because I take good care of my devices like a lot of people here. Would suck if I was forced to upgrade yearly.
My absolute favorite Mario Kart!!! First time I got to drive with motion controls. Have not looked back since. ^_^ Very fond memories of playing this game with my brother, father, best friends, and nephews and nieces.
I actually loved the cut scene ending in Pokemon XY. Made it feel cinematic. Besides, it was only 1% of the entire game. Now, if they made it too common instead of sticking with gameplay/user controlled (like the article author warned about) then yes I can see it becoming a problem.
@c2017nlifemedia ah, I get that. I probably should have said "character creation" like Fantasy Life. I'm hoping Level 5 considers making one for the Switch, and the same goes for Grezzo with Ever Oasis.
I do, primarily because of multiplayer. Which was why I had my eye on this game. But sadly there is no character customization (although Tethu is adorable) and no multiplayer. So it was a pass for me unfortunately. That made MHG my final 3DS game.
