@Not_Soos I think the point here is they’re denying the subpoena because it’s being delivered nearly a month after the deadline for any such subpoena needing to be submitted.
Example: If the rules say that you have 30 days to complain about a widget, and you complain 5 months later, then I have the right to ignore you, because you waited too long to complain.

If the emulator freely allows for commercial use, and the only thing that makes this "pirated" is the lack of credits, then that sounds like 1) something that is easily overlooked when trying to develop your own software, and 2) something that could easily be resolved by calmly talking to the concerned parties, and 3) this guy is WAY overreacting and being a drama queen. Shouting "pirated pirated pirated" over something that is already free and open source, is kinda douchy.

I find it hard to believe that this random "analyst" would be told "directly by nintendo".
There's really no reason for Nintendo to reject it. There are plenty of games that would not come directly to switch, so they're not missing out on anything in that regard. And plenty of people prefer to buy games directly instead of streaming, so that's not even a concern.
Nintendo has already allowed Hitman 3 and Control to be streaming. This is really just the next step.

I think it's impossible to judge Nintendo and this tactic right now, because nobody other than Nintendo knows what they're planning. What happens after the "time" is up, nobody knows. They may end up just releasing the game separately, in which case, why would it matter whether they were limited release as a bundle? There's companies that are devoted to limited physical releases of digital games, but nobody complains about them.

I was so excited for this game while it was in development.
Unfortunately, the game goes off the rails pretty early on.
And I'm not sure what the "message" you're claiming it's trying to say, but I found the story elements to be a HUGE negative part of the game, and really detracted from my enjoyment.
Overall, the game tried too hard to act like Portal, while completely missing the point as to why Portal was enjoyable.

The Switch already has all the benefits of a digital-only console. It doesn't have a disk drive.
The existing cartridge slot is small enough and non-intrusive, that removing it would not serve any benefits.
It's different for disk-based systems, where yeah there's a better benefit to just having it digital.

It doesn't take an analyst to say something like this.
I've been thinking about this for months. Once Apple announced Apple Arcade, I was like "this is brilliant!", and instantly thought how Nintendo should do something like it.
They're already kinda doing it with NSO's NES/SNES libraries, but I feel like they could do so much more and better. So much potential.
But yeah, Nintendo could make a $10/month subscription to get access to all of their published games, and people will flock to it.
