@kamifox1 DSi (and the 3DS) do not region lock DS games, but games which were made especially to work with DSi exclusive features were locked. So, for example, the DS remake of Fire Emblem Monsho no Nazo was able to play on any region DS, but would only use the DSi online features on Japanese DSi consoles... There weren't many DSi exclusives, which is probably why you might not have known about this.

@Sforzando @123akis I heard that the issue with flipnote studio was that there was a huge server overload even in Japan, so they wouldn't ("can't") release it worldwide. Of course, this is a pretty poor excuse, considering that they solved it for Pokémon bank and the eshop last year, within a few weeks, and it's been six whole months!!! I've even seen an early version in action, so the game is fully functioning. They should at least release the DSi version for 3DS until they solve these 'issues'. It would be better than nothing, after all.

In addition to this since, I don't know, 1985, games have always released in the USA first, or not at all in Europe. I was merely pointing out that the USA has been, is, and always will be the region in which Nintendo focuses most on.

@Dipper723 Actually, the emulator supports wireless data transfer, you can do something similar on the VC release of the Zelda Oracle games to transfer save data to continue on another copy of the game. So I would say there is a point.

It would be a public relations nightmare, not to mention that it wouldn't actually reduce any costs, as it really is just a disc drive and a posh emulator. The gamepad is poorly implemented, but then many games wouldn't work, so it would not really be of benefit. What they need to do is to stop selling all the 'accessories' with it. This means no more gamepad stands, etc etc, just console, gamepad, wires, game (cheap disc or code). No frills attached. They need to sell it simply- "You buy console. You plug it in. You have fun." Then they need to sell it at that price for a year or two, then put the price down again. And again. They also need the included standard game to be a recognisable title, that repetitive launch Mario title, a la Mario world. And they need it at the forefront of shops. And in prime time telly. And they need it cheaper- £150 to £200 tops. Then it would sell. Reducing price worked for 3ds, after all!

And why is it at all relevant that people have supposedly stopped buying retail 3DS games? Isn't the point of VC that you download them? And it's besides the point that the handheld seems to be going from strength to strength... Explain yourself!

I don't think we should forgive them. They are not hobbyists, they are a game company. If they wanted help they could have taken inspiration from Coliseum, or XD, on the GameCube. They make a huge amount of money out of the game, they ought to have made the engine better.
