VC's top games just being hyper-popular game is part of the reason why we don't have VC anymore. Why bother with Virtual Console, when you can just put your most popular games on a new service (with some niche ones, like Winback, in there as well).
Just remember how Sony ruined Soul Caliber. They were so angry that the Gamecube version sold better than the PS2 version, that they bought out the rights to Soul Caliber 3 (a move that would eventually ruin the sales of Soul Caliber).
Now they moan when other companies (aka Microsoft) does similar. Doing it is scummy, but nobody should try to pull out a holy card.

From the modern era. The NES games costed $60 (before inflation), but SNES and N64 games costed $70. This was before America decided on a set price point (Japan hasn't and probably never will have a set price point, with games like Scarlet and Violet being $37-$42 USD)
As for TOTK, I am probably not picking it up for awhile, but I think it will probably be worth $70. If you don't want it, don't buy it, and if you want it, buy it.

Little was known until it was very close to release, there was DLC announced before the game came out, and it costed $70 everywhere except in America. Now that it will cost $70 in America, Americans now have a problem with the cost of the game.
Drift is inevitable (my 3ds and Wii Nunchuck suffers from it), the Switch just has a poor immune system. Its annoying for sure, but there are many options to fix/go around the issue. Doesn't excuse it, but its not unfixable. Suing Nintendo for something that has happened in the entire industry since the mid 90's while using children is just not a good idea. Instead of suing Nintendo, try to reach a settlement where they promise that in future, they will make it so that Joycon's stop drifting frequently.

@Grumblevolcano How about just a new Star Fox instead? We have one on Switch (sorta), but people refuse to play it because of "Toys to Life" (even after that was removed), which is a shame.
@Vil We got Bowsers Fury in 2021, so that should be fine (be honest, we aren't getting a new Mario platformer until the next console comes out, because thats stupid to have the next game on Switch)
@Mando44646 Because they have a sweet deal going on with GameFreak/Creatures, and they don't want to ruin it, because even if they try to tell GameFreak to halt, GameFreak and Creatures can just say no, because they actually work on Pokemon, and they have the biggest combined stake.
@IronMan30 Also that Selects were rolled out at the end of the Wii's/Wii U's life when they were selling poorly, and people hated how it used a different color, so there is that to.
