Re: Japanese Analyst Sets Record Straight About The Sales Performance Of Switch

dleec8

@thesilverbrick Setting low goals also spooks investors as well. Corporate success is defined by growth, and specifically, year over year growth. Setting easily attainable goals sends a message to investors that upper management is either unable or unwilling to take the risks necessary to maximize the investors' return on the money they have invested into the company. Investors only care about one thing: Maximizing their return on investment. Setting easily obtainable goals is a contradiction to what investors want out of a company, and that leads to upper management losing their jobs, along with others in the company.

Re: Capcom Has No Plans "At This Time" To Release The Resident Evil 2 Remake On Switch

Was playing the RE2 REmake tonight on my gaming laptop and was indeed on the edge of my seat as I explored the police station and worried about the various dead bodies around me that may or may not have been the undead. I like to knife every body I come across to make sure. Alas, us Nintendo gamers have gotten used to certain big budget titles not releasing on our platform of choice, but that's why I bought myself a gaming laptop a few years ago to make sure I don't miss out on those other titles. However, my first choice would be to play games like REmake2 on a Nintendo console, even if the specs have been throttled down to make it work.

Re: Video: Updated Travis Strikes Again Intro Scene Clashes Suda51 Worlds Together

dleec8

I have to admit, I went 100% fanboy when I was able to place Dan Smith's voice before the game revealed his face. However, I started to assume it might be him right away due to the fact that the intro video reminded me of the opening sequence of Killer7 with Garcian walking down that street, with the surroundings looking the same in Killer7 as they did in the TSA:NMH. I went full on fanboy again when I saw that Smith was entering the Celtic Apartments! What a great little video and tease of both of my favorite assassin filled Suda51 worlds being forever one and the same! In the name of Harman!

Re: Nintendo Download: 17th January (North America)

dleec8

Travis Strikes Again because Suda games ooze that unique style, flash, and just plain out bat **** craziness that I can truly appreciate! Also currently downloading Onimusha Warlords because I never got to play it the first time around and love any well crafted game that features Samurai, Ninja, and feudal Japan. Why wasn't Onimusha featured on this list if it is being released this week as well?

Re: Friends Beat Family In The Splatoon 2 Frosty Fest

dleec8

I chose family this Splatfest, and this was the first Splatfest where I actually lost more games than I won. I had previously won more games than lost every Splatfest no matter what team I had chosen. I had SO many games where I would go on a blistering warpath across the map, inking large amounts of territory and splatting multiple enemies, only to get splatted myself and watch the enemy team roll over my teammates like it was nothing.

Re: Suda51 Would "Love" To Bring Killer7 To Switch, But It's All Up To Capcom

"Children are pure, they know who's the strongest."

I LOVED this game when it came out back in 2005. I played this heavily and had a blast trying to piece together the crazy plot while being thrown for a fun loop as every chapter just got more intense and crazy! I loved the surreal but stylish art style, the crazy and over the top characters, the near impossible to follow story line about Gods, assassins, and Japan wanting revenge on the U.S., and the crazy combat moves that just oozed style. I especially loved grabbing heaven smiles by the back of the head as Dan Smith, sticking the demon revolver in their mouths, and showing them why the killer7 were not be messed with! Mask de Smith suplexing heaven smiles into oblivion will never get old.

I didn't buy the remake on Steam because I was hoping for a Switch release. Please Suda51, if you are reading this, us killer7 fans are ready for this amazing game to grace a Nintendo platform once again!

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@c2017nlifemedia Here is it again for you, because apparently you don't know how to scroll back and read earlier posts:
"Many fans of the PlayStation and Xbox really do see them as entertainment centers that also play games. Nintendo does not want the Switch to be seen as an entertainment center/gaming device because the Switch can't compete directly against Sony's and Microsoft's consoles since those consoles fulfill that duel role so much better." It is an OPINION because I was speaking about millions of console owners who I believe view their console as more of an entertainment center rather then just a console that plays games only. That is an OPINION because I obviously do not know millions of PlayStation and Xbox gamers. I only know those in my personal life, and I used that EXAMPLE to help inform my OPINION. It is not that hard to follow along, although since you continuously fail to grasp what is an opinion and what is a factual example, maybe that is something you just have trouble with. It is an opinion if I attempt to explain what is in the minds of millions of gamers since I myself do not know millions of gamers. If you are still confused then you should read my posts. I give examples from my personal life and from articles, but I take those examples and form a broader opinion about gaming society as a whole. And again, I challenge you to meet someone for the first time and then call what they say dumb and see if they don't take that comment as an insult. I did not know this individual at all and my first interaction was him stating that what i was saying was dumb. Go meet people for the first time and then tell them that and they will judge you as being rude. This individual also took my personal experiences and implied that I was lying about them. Go meet a person for the first time and discuss an issue with them, then when they are done, call them a liar and question their personal experiences even though you don't know them. Once again, a normal person would consider you to be rude and wouldn't want to even talk with you again. Go out in the real world and interact with people like that and I guarantee you that you will not be liked. All that the other poster had to say is that he disagreed, and then he could have contributed to the topic from there. Completely discounting the opinions of others in a childlike way by calling them "dumb", and then implying that they are a liar for no reason other then just to argue, is cause to be ridiculed and exposed. I'm all for thoughtful discussion, but don't act like an immature child who just likes to argue unless you want to be exposed as an immature child. Not only did he come off as troll who just wanted to argue in a rude fashion, but he also didn't even have an argument of his own, and he moved his own goal posts several times when he couldn't explain what he was trying to argue. Go back and read that guy's posts and he was also making fun of another poster by saying he had Aspergers when that poster had a son who lives with Aspergers. It was obvious to me that this was not a decent human being. He should either learn basic human decency or be shamed into learning. I suggest you learn the difference between factual examples and the broader opinions about the world that these examples are used to inform. If you still can't understand, then you probably need to finish your education.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@c2017nlifemedia It is insulting to completely discount someone's opinion by calling it dumb. Espicially when that opinion is an educated one backed up by experience and statistics. If someone lays out an argument that is based in real world experience and statistics, and someone else calls that argument "dumb" without providing their own set of contrasting evidence that refutes the argument, then yes, it is insulting. Calling an opinion dumb is the same as saying the person who gave it was dumb for saying it. Try telling people their opinions are dumb, and then call them a liar like he did as well when he questioned the habits of my friends as if I made them up. If you dont think that calling someone dumb and calling them a liar isnt insulting, then i suspect you have not had much interaction with other human beings. If you are okay with people calling you a liar and saying your opinions are dumb, then thats on you, enjoy your life. There is also an element of basic human deceny that is an issue as well. It is not terribly hard to disagree with someone while showing respect for their opinion. If you walk around calling people's opinions "dumb" without offering your own argument that is backed up with evidence, then you yourself are an insulting individual who most people probably don't like very much.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@BigKing When did I ever argue that you do or do not consider your console to be an entertainment center that also plays games? My argument was that there are many gamers who use their console as more of an overall entertainment center then just a box that only plays games. That has been my consistent argument this entire time, backed up by experience and facts. First you said that was a "dumb" argument, then you tried to question the gaming/entertainment habits of my friends and girlfriend (people who you do not know yet you felt the need to comment on their habits like you actually know them), then you stated that more gamers mainly play games on their consoles rather than just stream media or watch movies (which was never the argument and which is a REALLY OBVIOUS statement that even a three year old could come up with), and now your argument is that you personally don't consider your console an entertainment center? Good for you bro, would you like a cookie too? You could have just said that earlier and that would have been your contribution to the topic. Instead, you acted like a clown. Either you have a hard time with reading comprehension, or you enjoy coming off as a bitter person online.

Once again, so your apparently slow moving mind understands me, my argument is that there are many gamers out there who use their console as more of an "entertainment center" then as a pure device for gaming. You yourself also fall into this category since you admit to watching Netflix on your console. I don't care if we use the term "entertainment center", or "movie box", or "fun container", or "smiley happy console center", the point is that many people use their console for more than just games. You seem to be caught up with the term "entertainment center" like its a concept you are opposed to. I don't care what you call it, you can call it whatever you want, but the truth of the matter is that many people use their console to do more then just play games. For some people, their top activity isn't gaming, but rather streaming media. Nintendo is not targeting people who look at consoles as boxes to both play games AND also stream media. They are primarily targeting people who are interested in playing video games, hence the reason why HULU is the only streaming option available on the Switch at the moment. Nintendo is trying to keep the focus on gaming with the Switch, and so far, that strategy seems to have worked quite well. Whether you want to call the Switch an "entertainment center" or a "BigKing FunBox" is all up to you, and frankly, I do not care at all what you call it. Stop trolling people and go do something fun in life, like hitting the gym, reading a book, or I don't know, how about PLAYING A VIDEO GAME. You could have been doing all that instead of coming off as a clown online. If you want to be a clown, then don't be surprised when people treat you like one. That goes for online, and in the real world as well.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@BigKing I never said that many more people use their consoles as entertainment centers over pure gaming devices, now did I clown? I argued that there are many gamers through who do use their consoles as more of an entertainment center than a pure device strictly for gaming. Of course there are many more gamers who use their console to mainly play games, that would be obvious since Playstations and Xboxes are VIDEO GAME CONSOLES. So you are saying that most gamers mainly play games on their video games systems? Good job figuring that one out, Sherlock. That must have took a lot of critical thinking skills for you to fully think that one through. The argument you were clumsily trying to argue was there there were NOT many gamers who use their consoles as entertainment centers, and you offer NO evidence to back up your child-like logic. I based my comments on the many gamers I know in my life, and based on articles I have read about the topic. Here is a link to one such article:

https://www.businessinsider.com/video-game-consoles-are-dominating-the-market-for-internet-enabled-tvs-2014-6

Here are some interesting statistics pulled right from the article:

"Half of U.S. households already own at least one video game console, and roughly one-third of these households use the devices to stream online TV and movies to television. That translates to about 19 million U.S. households using video game consoles as TV streaming devices."

"The use of game consoles as streaming TV devices isn't restricted to the very young. A Deloitte survey showed that video game console owners in their teens and twenties were the most likely to list streaming video to TV as one of their top activities, but the activity was surprisingly popular among older demographics, too. Thirty-two percent of console owners between 31 and 47 cited streaming movies or shows from services like Netflix or Hulu as one of their top three game console activities, as did 21% of those between 48 and 66 years old."

This article states young gamers are far more likely to stream media as one of their top activities on their console, but even 32 percent of 31 to 47 year olds list streaming as a top activity, and a fifth of 48 to 66 year olds do the same thing. That is a large amount of gamers who use their consoles as entertainment centers rather than pure gaming devices.

I have used my own life experience and actual statistics to back up my argument. You are just throwing out arguments that are made up with no basis in reality. In the real world, if you want to offer an argument, you back it up with facts, statistics, or experience, of which you have offered ABSOLUTELY NOTHING. To me, you just sound like some lonely dude who likes to argue with strangers over the internet. Get a life, or learn how to properly state an argument, you clown.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@BubbleMatrix82 I agree with you! My girlfriend spends more time playing games with me on my Switch then she actually does playing games on her Xbox. She doesn't own a PC, so she uses her Xbox mainly as her movie and streaming device besides the odd round of Crash or Xbox Kinnect when her family comes over. But she's far more interested in the Switch because of the more "casual" type games like Mario and Splatoon that seem easier for her to get into compared to the AAA titles that seem to always be popular on Xbox. These are the types of casual gamers or nongamers that Nintendo is targeting versus the "pro gamer" types who tend to flock to the other consoles. I was giving alot of my friends grief last night because they were all saying they were going home to squad up and play PUBG on their Xboxes while I was saying they should all get gaming laptops since it would be a better experience all around lol.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@BigKing When did I say she ever called herself an Xbox fan? You're making so many assumptions about who I am and who my friends and girl friend are that it sounds like you need to go make some friends yourself. Newsflash clown: There are ALOT of people in this world who use their console to watch movies and stream media on, SOME even use their console more for watching movies and using apps then they do games. My girlfriend plays games maybe 5 hours out of the week. She spends far more watching movies on it. Why is that so hard for you to accept or understand? Have you never met a girl in your life that you just can't believe that a woman could own a console and watch movies on it mainly instead of playing games on it? Go out and make your own friends and meet a woman who owns a console and maybe it will be easier for you to understand that these people do exist. You sound bitter about someone you've never met on the internet, which makes you just another dime a dozen troll.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@BubbleMatrix82 If you understand context, then you can easily see that I was writing about the phrase "entertainment center" as a device people are using to do more than just play games. I contrasted that with the Switch, which is a much more limited console in that it lacks apps, can't stream media, and can't play movies. If your reading comprehension is so bad that you can't understand the basic English that I was writing then that is on you. Go take an English class so you can better understand what people are writing before you ignorantly lash out because it's hard for you to follow along.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@BigKing I have many friends who use their Xbox or PlayStation as their entertainment center since they literally use it to stream media and watch movies as their main option over their PC or phone, so im speaking from my own experience. My girlfriend literally uses her Xbox only to stream media and watch movies like 90 percent of the time she uses it. So from what I have seen, yes, many people use their PlayStation or Xbox as their central entertainment option. So you can take your "dumb" comment and stick it in the trash where it belongs. If you have an opinion or an experience you would like to share, then share it, but no need to get aggressive. Sorry I didn't consult you before i posted my comment, but frankly, I don't care about you or your opinion. Try to show your fellow posters a little basic respect when you post. You will look like less of a fool.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@HollowGrapeJ I've been thinking of why they havnt just added Netflix to the Switch as well since your first comment, and the only thing that makes sense to me is that they want to make the Switch seem different compared to the other consoles. For example, many fans of the PlayStation and Xbox really do see them as entertainment centers that also play games. Nintendo does not want the Switch to be seen as an entertainment center/gaming device because the Switch can't compete directly against Sony's and Microsoft's consoles since those consoles fulfill that duel role so much better. So if a consumer walks into a store and has the choice between the three consoles, Nintendo wants the consumer to think hmm well the PlayStation and Xbox are powerful entertainment center/gaming consoles, but the Nintendo Switch is a pure gaming device. Since I already own a smartphone, computer, or smart tv that can play all the apps I want, I'll just go with the Switch since it's a device meant for a pure gaming experience. It's a marketing strategy called differentiation, where you want your product to seem unique compared to rival products. A unique product generates value in the mind of the consumer. But this is just my educated guess as an answer to your question, because the Switch already has the Hulu app available on the eShop, so there is a mystery as to why Netflix hasn't been okayed for the system. It might have something to do with money.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

@HollowGrapeJ I never said that Nintendo has never tried to add apps to it's consoles in the past to compete with the apps offered on other competitors consoles. I stated that it makes sense in the present for Nintendo to not compete app for app, power for power, and spec for spec, against Sony and Micrsoft consoles since these consoles are essentially turning into PC's anyway. Nintendo in the past has tried to go in direct competition with power for power and spec for spec against it's competitors, and it correctly realized that this was not a sound business strategy since Sony and Microsoft are literally willing to invest tons and tons of money into producing souped up consoles that double as entertainment centers, which now basically compete against gaming pcs and laptops. Sony and Microsoft are also much bigger companies where gaming is only a single division of the whole company. They have much more resources to invest in their consoles, so even when their console fails, they can use profits from other parts of their business to reinvest back into the gaming division. Nintendo is a pure gaming company first and foremost, so if they fail with a console, then it means their entire company is in trouble. This is why it is wise for Nintendo to try to focus on pure gaming in the present, because not only is it what they are best at, but it's their best strategy as a company who doesn't have the same amount of resources as their much, much bigger rivals. At no point in my earlier comment did I state that Nintendo has never tried to directly compete against their rivals. The GameCube, for example, was a console designed to compete power for power against Sony and Microsoft consoles, and the Cube failed spectacularly (although I will always love the Cube!) Then we get the Wii, which was underpowered compared to the PS3 and Xbox360, but which was a spectacular success for the company. From here, you can see how Nintendo is wary to go head to head against competitors when they know they can succeed by offering something that is more focused on the gaming experience, as opposed to trying to turn their console into an etertainment center/gaming pc like Sony and Microsoft are hellbent on doing every console generation.

Re: Reggie Says Nintendo Competes For Consumer Time, Not Concerned About Direct Competition

dleec8

What he is saying makes perfect sense though. Consoles in the style of Sony's or Microsoft's are increasingly becoming closer and closer to becoming gaming PC's. Since I already own a gaming pc, which I can also surf the web, watch Netflix on, and use other apps on, I really don't care if Nintendo isn't matching these consoles power for power, spec for spec, and app for app. I love Nintendo consoles because they retain that video game "feel" that the original NES and SNES possessed. I have a smart tv with Netflix and other apps on it, and I'd rather use my t.v. to watch these apps then do so on my Switch. Nintendo is wise to focus on the fun factor of gaming by itself, because Sony and Microsoft are going to keep burning money on trying to make their consoles as feature rich and powerful as possible until they are directly competing with PC's, and then what would be the point of owning an Xbox when I could just spend my money on a much more feature rich and powerful gaming laptop or pc that plays many more games anyway? Nintendo needs to focus on what they do best, and that is remaining the gaming "purist" in an industry where the borders between pc gaming devices and console devices are becoming increasingly blurred.

Re: Soapbox: Why Do We Want More Games When We've Already Got Too Many?

dleec8

@MrVariant I agree in that I don't feel like I need to "100%" every game. I was a big time completionist when I was a kid, but then again, I had the time and smaller game collection that allowed me to try and 100% every game I own. Now, I will try to zip through a game to at least finish it if I feel like it isn't one of the better games I own. Or I simply stop playing it, as you also do. I still try to 100% the games I truly love, like I tried on Xenoblade Chronicles X for Wii U, or on every Zelda or mainline Mario game I play.

Re: Soapbox: Why Do We Want More Games When We've Already Got Too Many?

dleec8

I have a MASSIVE backlog that would most likely keep me entertained for the next five or six years if I just played through it. I believe there are three reasons why I have developed this backlog:

1. I am fulfilling childhood wishes of being able to buy all the games that I want. I know I shouldn't be purchasing these games, but at the time of purchase, I have already slipped back into that childlike mindset where I am picturing how awesome the games are going to be and how much fun I will have playing them.

2. The HYPE factor. I get caught up in the hype of new games and want to purchase them and play them so that I can get in on the hype train. Case in point: I was super hyped for Mario Tennis Aces on Switch. I was reading all the pre-release hype, and I played the demo heavily. I bought the game on release and to this day I have actually played more of the demo then I have of the actual game. It is an awesome game in my opinion, but I just don't have the time to get back into it when I am too busy playing other games that I am actually really into at the moment.

3. SALES AND DISCOUNTS, I HAVE BEEN A SUCKER FOR THEM. My backlog has grown exponentially because I have been buying games when they go on discount. I think to myself that it is great value to buy these games while they are on sale, without thinking that there is no value since I can't even imagine when I will actually play these games for any appreciable amount of time in the near future.

We all love games for a variety of reasons, but when we buy things that we will not actually use any time in the near future, then it becomes hoarding. I have hoarded a massive digital collection of titles on Wii U, 3DS, and the Switch. The only saving grace is that it is digital hoarding that does not take up any space. I feel sorry for the physical hoarders who have piles and boxes of games sitting around collecting dust. I also feel sorry for myself though lol.

I will be a more disciplined video game purchaser and player starting today! My wallet and self-respect demands it!

For all of the people who mindlessly complain about Nintendo not "caring" about their fans for various reasons, this just goes to show what kind of company Nintendo truly is. They didn't even have to acknowledge this young man's request, but they did, and they made sure that one of his last wishes while he still has time left on this Earth was fulfilled. It brings a tear to my eye to read this story because none of us know when our time will come, but we will all wish to be comforted when it does happen. For Chris Taylor, Ninentendo came through for him and did what they could during his time of need. I hope nothing but the best for Chris during the upcoming days and months, and he will definitely be in my thoughts.

I was able to beat Pokemon Red when it first came out when I was 10 years old using only a Venosaur and a Hypno. I literally brute forced my way through the Elite 4 using tackle and razor leaf from my Venosaur and using Hypnosis and Psychic from my Hypno. I didn't use any real strategy beyond that because the game didn't force me to. You all saying that game has been dumbed down are forgetting how easy these games already are and were in the first place.

Re: Final Fantasy: Crystal Chronicles Remastered Will Be Digital-Only In North America

dleec8

@JessM87 I understand what you are saying, and I agree that buyers should have options. I used to be a physical only die-hard too, but that was before I experienced having all of my physical games stolen from me on two separate occasions, and before I started to realize that having less stuff laying around my house was better then keeping a bunch of things that I hardly looked at or had a use for. But like you said: Everyone has their own thing that works for them, and there is no right or wrong way of playing games.

I would like to leave you with this though: Many more gaming companies are going to decide for you that you need to go digital. The cost of producing physical carts is going to drive more companies to produce digital only titles so that their profits on these games increase. As more and more people go full on digital, and less and less buy physical media, gaming companies are going to have a very low incentive to shell out extra cash to produce physical games. It will soon not make sense for these companies to produce physical copies at all (with the exception being special edition box sets) because the amount of profit they make on physical copies will be nothing compared to digital downloads.

Re: Final Fantasy: Crystal Chronicles Remastered Will Be Digital-Only In North America

dleec8

@stephenmunn It is true that having a digital license to a game does not compare to having physical copies that you own for life. But for someone like me, the hassle of swapping out carts, and constantly moving around my game collection/boxes as I find that I need that space for something else, does not compare to effortlessly switching from title to title on a hard drive or memory card.

Here is another fun fact: I have had two different Nintendo consoles (N64 and Gamecube) stolen from me at two different times in my life when I was 13 and when I was 18, along with ALL of my physical games for those consoles at the time. At least with digital games, I know that I can re-download them at any time. You may reply with an example of servers and downloads becoming unavailable, but by the time that actually happens I am pretty sure I will have moved on to whatever new games that interest me in the future. As I grow older I also find that I want to own less possessions that are collectible, and own only things I actually use on a consistent basis. So for me, holding on to "collectible" items like game cases and boxes has lost almost all of its appeal. I only buy physical now if it is a special edition box set that I really want to get because of the extras thrown in.

Re: Review: Monster Hunter Generations Ultimate (Switch)

If I already own this game on 3DS, but have not yet played it, is it worth it to spend the extra cash and just play the switch version? If the experience is at least 50% better than it would be on 3DS, then I would be willing to pay for the game again to play it on Switch.

Re: Nintendo Enforces Takedown Of Fan-Made Game Creator Pokémon Essentials

@KingdomHeartsFan If this website was hosting tools which used game assets that were directly ripped from Pokemon games, and there were also click advertisements on this website, then yes, the owners of the website were attempting to profit off of the popularity of the creator tools. Websites are not free. They are paid for through sales, or through advertisement revenues. Just because the website wasn't trying to sell Nintendo's IP to their visitors doesn't meant they weren't profiting off of that traffic with advertisement click throughs.

Re: Nintendo And ROM Website Owner Looking To Avoid Lengthy Court Proceedings

dleec8

If you had read my first post on this topic, you would have read that when I was a child, I met many other kids who pirated ROMS. They pirated ROMS because they were free games. Kids love games, and they espicially love free games since kids are usually broke (since they are children). And trust me, there were no adults promoting ROMS to us. Kids passed on various websites to each other where ROMS and emulators could be downloaded. I have yet to meet a child who was "forced" to pirate anything because of pressure from an adult. And I never stated that children in particular promote piracy. What I did say was that i feel that children are more likely to not understand the laws that govern copyrights and what you can and can't do with a purchased piece of media.

Re: Nintendo And ROM Website Owner Looking To Avoid Lengthy Court Proceedings

dleec8

@Priceless_Spork Lol at comparing a website which has uploaded illegal roms, which can be down-loaded an infinite number of times, to a library system where individual, physical books are loaned out that must be returned. The problem with many of the people trying to argue in favor of illegal ROM websites is that they are completely unfamiliar with the business laws that govern fair use and copyrights. Let me inform you. Libraries are allowed to let people borrow their books because #1 The library paid for those physical books. Once the physical book is purchased, the library retains ownership rights to those specific copies of the book. Now for: #2 Under U.S. Copyright Law, The owner of a copy of media, such as a book or a physical game cartridge, is allowed to share that copy of the media with anybody they wish. This is called the First Sale Doctrine. It means that if you purchase a copy of media, you are now the owner of that media, and you may resell that particular copy to someone else, let someone else borrow it, or donate it if you want - And that is all within your right as the owner. However, the copyright holder holds reproduction rights to that piece of media, which means that you cannot reproduce that media or else you will be breaking copyright law! That means that if you own a library, and you want more copies of a popular book, you must purchase those copies either brand new or second-hand. The library MAY NOT REPRODUCE THE BOOK ITSELF AND MAKE NEW COPIES. This is exactly the problem with ROM sites. ROM sites basically offer infinite copies of media to anybody who decides to download. This breaks copyright law because Nintendo has never sold licenses to reproduce copies of their games. They only sell individual pieces of media - such as physical cartridges or discs, or individual downloads that are offered online. They do not sell licenses for any guy with a Super Mario Bros. cartridge to upload copied Super Mario Bros. ROMS on a website to the entire world for free. That is stealing someone else's copyrighted material and making illegal copies for other people to steal. That is basic theft, and I hope you now have a better understanding of the very real laws that govern this kind of thing. Libraries and ROM websites have literally nothing in common.

Re: Nintendo And ROM Website Owner Looking To Avoid Lengthy Court Proceedings

dleec8

@BlueOcean When did Nintendo tell you to "forget" about all of your old purchases? I never get this argument because if you purchased VC titles on the Wii or Wii U, you can still play them whenever you want, can't you? I don't recall Nintendo telling people to delete their old VC or to forget about them. I filled up my Wii U hard drive and my 3DS micro SD card with VC titles knowing that I could easily play them at any time in the future if I desire. And I still do - I was playing Ninja Gaiden 1 on my 3DS this morning. It is your fault if you unplugged your system and can't play your games anymore, not Nintendo's. And Nintendo's new online service with NES games coming back are being upgraded with modern features, such as online play, and you left that out of your complaining. It should be noted that Nintendo isn't just rehashing these NES games, they are given us something we have not had before. I find it amusing that you say that Nintendo is ripping you off for "basic roms" when these games are literally their property, that they own and created, that they are selling to the public. If you don't want to buy, then don't buy, but stealing the games when you refuse to buy them (like some ROM theives do) just makes you a thief in every sense of the word. Not saying that you are a thief, but anybody who downloads ROMS illegally is literally a thief.

I seriously believe that the only people who really debate this issue are children, or those who have no experience at all in business. Nintendo must defend their IP because it is literally their bread and butter, their property, and their business valuation may be damaged otherwise if investors start to believe that thieves are openly profiting off of Nintendo's IP without them doing anything about it. Nintendo is already pretty tight about the image that they project as a maker of video games, and I imagine they have no tolerance for these so called fans who think nothing of literally stealing the property of the company who they supposedly are fans of. We as consumers have no right to Nintendo's goods and services unless Nintendo has agreed to sell it to us. If they have not agreed to sell their products and services to us, and we are instead pirating those products, then that is theft by law. I have met plenty of people who rip off ROMS. Many of them I met in middle school and high school, and they were ripping off ROMS because they were broke kids who couldn't afford to purchase these games in any other way. I have also met adults in the present who rip off ROMS, and most of them are similar to the kids in that they are unemployed and broke. Because they have no money to buy their own games, they download ROMS of whatever they can find to entertain themselves. Of course there are those who simply download ROMS because they don't think anything of it, but in all three cases, theft is still theft. I have no desire to download ROMS when I own most NES and SNES games I want on Wii U VC or 3DS VC, where people can support Nintendo by purchasing these games that they are offering for sale, not to mention the NES Classic and SNES Classic. Support the company you profess to love instead of ripping them off. I owned plenty of NES and SNES classics on my original NES and SNES consoles when I was a child, but that does not mean that I believe that I am entitled to illegally own the ROMS of those games for the rest of my life. The cartridges were what was originally paid for, and with those long gone, I had to repurchase those titles if I wanted to enjoy them again. You can either be in both the moral and legal right (from not stealing goods and services from a company), or you can literally steal goods and services and be a thief.

@Euler At the end of the day, I agree with you about Smash being a celebration of all things Nintendo. At its heart, that is what it is. It is as much a game as it is a celebration of the Nintendo universe and all those things that inhabit it. From that perspective, I can understand Nintendo fans being apprehensive about allowing in characters who previously had nothing to do with Nintendo (such as Cloud). However, I was a HUGE FF7 fan when it first came out, and I still love that game to this day. I was happy to see Cloud in Smash Bros if only to say that I could finally play as Cloud on a Nintendo system lol. But I thought it was a fun inclusion, just like I thought Snake was a fun inclusion even though the style of the Metal Gear games is almost the exact opposite of the style of a typical Nintendo made game. My only thing about these arguments over who gets into Smash and who doesn't is that some people seem to forget that these games are supposed to be fun. I would honestly having fun playing as Goku in Smash, even if he would seem somewhat out of place. But didn't Snake seem like a guy who would be out of place as well? And I understand your argument with bringing up Shrek and Potter and those other characters, but I believe the reason people bring up Goku for Smash so much is because hes already a fighting game character himself, and comes from an anime and manga series based on fighting, so his inclusion into a cartoony fighting game kind of feels natural if not for the fact that combining him and Mario seems like such a weird combination. But then again, Solid Snake and Mario is even weirder in my opinion.

I said there were no rules beyond whatever the developers deem is appropriate. I promise you that if Nintendo determined that their net revenue from Smash Bros alone would jump by 50 percent if they secured the rights to put Goku in the game, they would do it in a heartbeat. As much as they are a company who stays true to their artistic vision for how games should be, they are also a company with shareholders to please, and they would pull the trigger on Goku if A) They were able to secure a profit sharing agreement with those who hold Goku's media rights, and B) They determined that they would enjoy high enough net revenue from his inclusion to the point where it would make all the financial sense in the world to put him in.

The real argument here is whether or not including Goku breaks the "spirit" of what Smash Bros is supposed to be. At first, Smash Bros was a Nintendo-character only brawler full of fun fan service in the form of Nintendo character trophies, music from various games, and other goodies for the fans.

Now, it can be argued that Smash Bros has transformed into a celebration of all notable video game characters who have appeared on Nintendo consoles. In that sense, Goku has appeared in at least 15 different games for Nintendo consoles (That is a rough estimate off the top of my head) , so his relevance as a video game character on Nintendo consoles is well established.

I don't care at all if Goku is included or not, but I feel that the rule that "only characters who originated in video games" can be included in Smash Bros is a ridiculous one because some characters have appeared in enough video games that they have made that transition already. I have tons of great memories of playing as Goku in far more games then I do playing as some of the other characters on the Smash roster.

This whole argument over whether Goku qualifies so be a character in smash is ridiculous. There are no rules over who appears in Smash other than what the developers think would be appropriate. Although Goku did not originate in video games, I have personally owned 7 different Dragon Ball (Z) games, including Xenoverse on Switch, so I believe Goku's legacy in video games is extremely established by this point. Goku has transcended his manga/anime origins, just as Mario has far surpassed being a mere video game character. The argument that letting Goku in would open the floodgates for other characters like Shrek to get in makes no sense at all. So if the developers let Goku in, they will all of a sudden be forced to let in movie characters like Shrek who have no memorable or notable video game legacy? It makes no sense at all and is just a weak argument for argument's sake. The purpose of this game is for us the players to have fun and enjoy ourselves, and I know for a fact that me and MILLIONS of other players would enjoy seeing Goku in smash. Will it hurt me deeply if he isn't in it? No. Will it ruin the game for me if Goku, who has starred in more video games than many other actual characters who are in Smash, is put into the game? No it will not. I have complete confidence that this will be an amazing game when it comes out, and that is with or without Goku.

What I have noticed recently is with the uptick in the number of users visiting the site is that the number of user comments complaining about things has also gone up. I worry when the vocal complainers start to outnumber the people who want to share positive gaming moments and stories. Of course, Nintendo and the games that come out on their systems are not without fault, and healthy complaining is a normal part of life. But I do worry about this site becoming more toxic than positive in some areas on the website user comment PH scale.

@stuie1234 No worries man, I got battered myself when I started playing online and lost my first 5 games in a row. Then I went on a winning streak and just now got to the final match in a tournament, but lost it. The game is full of strategy, and playing more and more online shows you the different types of shots that are better in certain situations, and you also start to learn how to fake-out the other player and make them think you are about to do something that you are not actually about to do. Try playing with different characters too. I got destroyed as Mario, but started obliterating my opponents as Peach.
