@BlubberWhale it sounds like they told the tournament what was acceptable and asked them to comply, and were rebuffed. That was about as much creativity as one can ask from a corporation, frankly.
@Yorumi the only "should" Nintendo cares about is maximizing shareholder value. Which will involve violent defense of their IP. It's like getting angry at the rain or earthquakes.
@BlubberWhale No, but they can't have Melee online without getting a C&D from Nintendo. That's just how it is, Nintendo has the right to do it, and will always exercise that right. Like, every time.
@Minfinity the tournament could have gone on if they listened to Nintendo and stuck to Ultimate. They "stuck to their guns" so Nintendo shut them down. The reason they can do that has nothing to do with emulation or piracy, it's right of performance: in the cases of film, music, or video games, the IP holder can stop public use of their art. So if you are a musician, you can stop a politician you find distasteful from playing your song at a rally, or in this case, Nintendo can stop a public event or venue from using their IP, including Ultimate, for commercial purposes, for any reason they feel like.
Defending copyright and trademark is in no way a shady practice. They acted within their legal rights. Falcon a d their partners were the shady ones here.
@NathanTheAsian I'll believe there were dips, just nothing I noticed playing the demo or that I would notice in the full game: it's just not going to impact the game for me.
@StevenG no, that's objectively untrue: there is no practical difference beyond 24 FPS in terms of responsiveness or control, neurologically. Most people can't tell the difference beyond 24 FPS, and for those who can tell the difference it doesn't effect performance. This has been demonstrated, objectively.
@StevenG no, there is no meaningful, objective difference: again, neurologists have been pretty clear on that point, there is no significant difference in measurable objective perception past 24 FPS. There may be some subjective taste in some cases (it is possible to detect the difference for some people, but it doesn't effect processing performance past 24FPS).
@StevenG 24 FPS is the point in the bell curve where there is no practical difference and anything more is just diminishing returns, which is information easy enough to find out there.
@vatrafetru it seems that a copy of Mario Kart 8 sells about every other time someone buys a new Switch: as long as the Switch keeps selling to new people, people will keep buying Mario Kart to go with it (or it will come prepackaged a lot of the time, but they make it the paxk-in because people like it).
@yuwarite If they get enough of a cut, it might be to their advantage to sign on to Gamepass. With Microsoft, Sony, and Nintendo first party titles, Gamepass would be a must have for gamers, and all three could profit, without Sony or Nintendo having to develop their own world-class internet infrastructure.
@Kalmaro If it happens, I'm in, full on. I haven't had an Xbox in a while, but Gamepass is a tremendous idea. With Nintendo content, with cross system play, it would be a no-brainer.
@Krull Switch will probably pass the 3DS by the end of Nintendo's fiscal year, based on their sales as of their last report and the projections they provided investors. They are on track to sell 30 million Switches this FY, which is bonkers.
@NathanTheAsian The period in question wasn't durign the early years of the box 360: the 360 streak was after the Kinect release. That's why Xbone started off touting Kinect, they thought it was the future because it sold like hotcakes.
@Kalmaro Yeah, it's pretty obvious that Phil Spencer's dream is to get Nintendo and Sony to buy-in to Gamepass and freeze out Amazon, Google and Apple.
@Bomberman64 as you say, I can only speculate and speak for myself: but as a Nintendo fan and PC Gamer who enjoys Indie games, I've found that for the focused play experience of an Indie game, the Switch platform is perfect. I don't need a whole keyboard and mouse set-up when a pair of Joycons will do.
I wouldn't be surprised if there is a huge Venn diagram overlap between people who enjoy Super Mario Bros. and people who like Indie experiences, for that matter: Nintendo fans are the natural audience for this sort of thing.
The hybrid model is here to stay, Nintendo will never go back to having seperate platforms. A few years from now, we'll probably see a generational leap with Nvidia's latest tech, with some wild Nintendo twist, but it will be a hybrid.
The reason why Nintendo doesn't compete head to head in the home space with Sony & Microsoft is simple: Microsoft is losing $200-250 on each Series S/X they are selling, reportedly, and Sony is also not afraid to lose money on each console sold. Nintendo means to make a profit, and can't meet the price point of their competitors with a directly comparable tech spec. Been that way since Microsoft entered the market, and Sony learned their lesson by charing an accurate price for the PS3 at first.
Going through the list, it strikes me what a low percentage of N64 games I actually played over years of owning it, but the one sI did play were mostly fantastic...

@leathco Nintendo apparently offered to let them do an Ultimate tournament and were rebuffed, but once the C&D hammer comes out there is no nuance.

Re: Ubisoft's Immortals Fenyx Rising Teams Up With Adventure Time
@HollowSpectre I mean, I kind of feel that's what this implies.
Re: Microsoft Won't Be Taking Bethesda's Games Away From Nintendo Platforms
@Dm9982 same here, and Phil Spencer knows it. Not a big Xbox fan these days, but I appreciate his philosophy.

Read "we want to get Nintendo and Sony onboard with Gamepass so we can beat Google and Amazon."
Re: UK Charts: Switch Games Pushed Down The Pecking Order As Next-Gen Excitement Takes Over
@LordMolecule oddly enough, the Wii U and the Switch are both the same hardware generation, part of the 8th generation of video game consoles.
Re: UK Charts: Animal Crossing Retakes Second, But Pikmin 3 Sees Disappointing Drop
If Japanese and digital sales stay strong, Pikmin 3 Deluxe could still be on the way to bring the best selling Pikmin title.

Re: What's Up With The Frame Rate In The Hyrule Warriors: Age Of Calamity Demo?
@NathanTheAsian I certainly wouldn't have noticed the difference just playing through the demo.

Re: What's Up With The Frame Rate In The Hyrule Warriors: Age Of Calamity Demo?
@StevenG no need: the neurological science is pretty clear on the lack of meaningful difference past 24 FPS, and it's not worth worrying about.
Re: What's Up With The Frame Rate In The Hyrule Warriors: Age Of Calamity Demo?
I played the whole demo, never encountered anything noticable, but FPS is basically meaningless in my general experience past 24 FPS anyways.

Re: Random: Bowser Shares His Top Three Favourite Horror Games (Doug Bowser, That Is)
I'd go with Eternal Darkness, System Shock 2, and Bioshock.
