Anyone who is defending this guy's actions and condemning Nintendo for theirs are completely blind to copyright law. Regardless of whether or not you think his videos are cool and want them to continue, it is strictly illegal to profit off of other's intellectual property. There's no gray area here. Mark Haynes is clearly in the wrong, and acting like a butthurt child.

That being said, he's playing it smart on his new Patreon by not mentioning what the funds are actually going to (even though it's extremely clear due to the trail of breadcrumbs he has left behind). Either way, talented as he might be, I will not be supporting him because I don't give my money to butthurt children.

@Michael_JF In a sense, yes, but not in the same way that a 3DS game generally goes into sleep mode. All DS and 3DS games go into immediate standby mode when the shell is closed. GBA Ambassador games do NOT go into standby mode. The sound and screen will shut off, but the game continues processing (progress is not 'frozen' as it would be otherwise). Certain GBA games do include a software based sleep mode however, but again, the 3DS hardware based sleep mode remains unsupported.

@Serebii Unlike all other Virtual Console games, the GBA Ambassador games aren't running on specially coded emulators. They are straight ROM dumps running off of the 3DS's secondary CPU (essentially the "Nintendo DS Chip" that allows the 3DS to play DS games, but which also handles the 3DS's background processes). This CPU, like with the DS before it, can be down-clocked to run GBA games.

This is why there's no sleep mode or restore points or anything of the like. This is also why the 3DS home menu can't be reached and no standard wireless or background processes can be realized. The CPU can't do anything while simulating GBA games aside from.. well, simulating GBA games. This is also why Nintendo hasn't re-released them as is to the general public - they aren't technically up-to-snuff with Nintendo's Virtual Console emulation standards. They were, however, quick and easy to produce (again, they're simulated software, not emulated software), making them perfect exclusive giveaways to early adopters.

Also, since these are GBA ROM dumps running off of down-clocked Nintendo DS hardware, they are EXACTLY the same as when playing the same games via cartridge on the DS. Any perceived glitches, sound issues, or ghosting? You're mistaken - they were always there, they were just less noticeable on the antiquated hardware.

Mario Kart 8 is the more refined game, but I've never loved a kart racer more than Sonic & All-Stars Racing Transformed. The sense of speed, the gameplay variety, the weapon balance, the challenge.. it asks so much more from the player, but rewards those who master it (plus it actually has battle modes!).

@SuperWiiU The 3DS/Wii versions actually have a completely different set of courses than the Wii U racing mode. Wii U initially only has 6 courses, while 3DS/Wii initially has 15. Buying all 3 Racing Action Packs unlocks an additional 6 courses in each game. So in total, Wii U gets 12 courses (4 per vehicle type), and 3DS/Wii gets 21 (7 per vehicle type). And from what I've played so far, there doesn't appear to be any courses overlapping between games.

@FragRed Considering the pricing structure for downloadable Wii games is currently the same as the HD remasters for REmake and RE4, I don't think charging more would be an issue. Plus, aside from 2 retail games and 2 eShop games from years ago, re-releasing legacy games is essentially Capcom's only real footprint on Wii U, with over 25 VC games on the console.

@Tasuki The makers of this game secured the licensing BEFORE launching on Kickstarter. The makers of the proposed Ghosts n'Goblins game hadn't, and tried using the Kickstarter as leverage to secure it. Unfortunately for them, Capcom wasn't having it. And understandably so. Publicly seeking funds for something you have no right to isn't exactly a good way to build a corporate relationship.
