I didn't find your arguments in the article very compelling, especially when you said you rather liked having to jump through hoops and spend a whole lot of money to play imports. I've never imported a game and honestly I'm not likely to start doing so, but region locking is anti-consumer and I want it gone.

I have bought only digital so far, other than the Nintendo Land pack-in, so yes, I would definitely take advantage of a new release discount on digital downloads. I would also take advantage of promotions on already released games. There are several retail downloads available in the eShop that I'll pick up if/when they go on sale.

I would be much more likely to go in for one of these digital downloads if they were on the Wii U. I play quite a bit on the gamepad while my wife and I watch the tube and I would love to play StarFox 64, but if I can only play it on the television, I won't bother.

These new characters might be perfectly suited to the game, but one of the reasons the Smash Bros. series is so valuable to Nintendo is that they can do this; insert new characters to give them a sort of legitimacy. They may not have been added for "cheap novelty," but they are certainly there in part to remind players of these other franchises. Nothing wrong with that, just good business sense. No complaints here, as long as they keep it reasonable and don't cheapen the experience.

@Fazermint Actually, if by "emulate a game" you mean to download and play a ROM, that is illegal, at least in the US. However, if by "emulate a game" you mean to make a copy of a game you own, the legality is unclear, at least in the US.

This is from a page from the Electronic Frontier Foundation's website http://w2.eff.org/IP/eff_fair_use_faq.php:

"Although the legal basis is not completely settled, many lawyers believe that the following (and many other uses) are also fair uses:
Space-shifting or format-shifting - that is, taking content you own in one format and putting it into another format, for personal, non-commercial use. For instance, "ripping" an audio CD (that is, making an MP3-format version of an audio CD that you already own) is considered fair use by many lawyers, based on the 1984 Betamax decision and the 1999 Rio MP3 player decision (RIAA v. Diamond Multimedia, 180 F. 3d 1072, 1079, 9th Circ. 1999.)
Making a personal back-up copy of content you own - for instance, burning a copy of an audio CD you own."

The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic. Therefore, whether you have an authentic game or not, or whether you have possession of a Nintendo ROM for a limited amount of time, i.e. 24 hours, it is illegal to download and play a Nintendo ROM from the Internet."

It may be illegal to emulate, but the Ouya itself is not illegal, at least in principal. Emulating Mario on an Ouya would be the same as playing illegally obtained music on your iPod. Plenty of people do it, but the company that owns the hardware would be well advised not to market their product as a device for playing/listening to "free" games and music. You may recall the original iTunes ads with the "Rip. Mix. Burn." tagline. The difference is that Apple never sent out tweets saying, "Hey, go and find your favorite songs online for free and play them on our device!" Not a smart move by the Ouya folks. Just plain dumb actually.

I agree with the other posts here. I've played many games considered violent by others and I have yet to slash a friend's throat with a knife.

On a somewhat related note, the moderation on Miiverse seems a bit over the top to me. I posted a comment the other day on the Lego City forum. I posted an in-game photo with a joke comment that included the F word, which I self-censored, starring out all the letters save the F. I knew this might fall afoul of Miiverse policy and sure enough my comment was removed. I realize Miiverse is meant to be very family friendly and I don't want it to be full of idiots calling names and whatnot, but I would love an option to have an 18+ setting that limits the moderation of comments to at least allow the occasional curse word.

If they maintain the rather small character limit on posts, which certainly needs to be increased, they definitely need some kind of hash tag system like Twitter. They should at least increase to 144 so with the upcoming mobile app it will be possible to cross post on Twitter.

I'm planning to buy it in the next week or so. That sales threshold is just absurd though. Why would that exist? Nintendo is clearing these games for sale on their service, so why would they screw over developers like that? It just sounds douchey.

Nintendo: We'll sell your game to our customers and keep all the money.
Dev: Uh, that sounds like a terrible deal.
Nintendo: But if everyone buys it, we'll toss you a bone.
Dev: Umm...

Glad they changed things up for the Wii U, but seriously, that is just a stupid, stupid idea.

I have no doubt that these recycling programs are outsourced to other companies and that these companies "recycle" these products in more ways than one. I imagine somewhere along the line someone will salvage ROB and save him from a most terrible fate. I hope this guy doesn't have to commit a crime to accomplish his goal. That would suck for him.

iOS and Android are great for certain types of games, but virtual buttons just stink. I've yet to meet a virtual button setup that worked well. My fingers invariably end up moving off the buttons at crucial moments and it's not fun to be constantly concerned about that. Super Crate Box, I think that's the name, is an excellent example. Fun little game. Basically like single-player original Mario Bros. but with guns. Virtual buttons drove me away.

Other than Nintendo Land, which came with the system, I only have downloaded games. I think I'll stick to it, as long as the sales keep coming. I bought Sonic Racing because it was only 40 bone and I picked up AC3 during the Ubisoft sale. The Premium discount adds more incentive. I don't really buy many games, so this is a good system for me. And if I want something that I think might not be very good or received mixed reviews, I'll buy a used physical copy.

I've not played any of the ME games. I'll probably get this at some point, but the high price relative to the trilogy packs on the other systems makes it feel like a poor deal. When it hits $25-30, I'll probably take the plunge. Hopefully a downloadable version will show up.

@indienapolis I'm in the same boat on off-screen play. I enjoy playing off-screen and if I'm in another room, the minor convenience of not having to switch discs is pretty awesome. And with the discount from the deluxe promotion, AC3 is a few bucks cheaper as a download than it is on Amazon. That makes it worth it as a download for me.
