They need to do this already. If you have an in-store warranty, a lot of times they ship your 3DS off before you get your new one - you can't do a transfer.
Air Battle Hockey 3D is pretty good unless you're a lefty (the control scheme). They could have easily fixed this... Anyway, it's like a 3d version of the flash minigame "Curve Ball", with special powerups added.
Colors! 3D was originated from Colors!, an amazing homebrew app for the DS. This, along with Hugo, are just a few of the many examples of how homebrew isn't bad. The 3ds hacking that people are so worried about was no more than a "Hello World!" app...

If it is a small amount of figurines (say six figurines) I'd say that's fine. If it is a Skylanders amount of figures, no thank you.
Edit: The game itself is 1800 yen, so $19 USD-ish. I have a feeling they'll come out with 15-20 figurines.
