From the text for the article, it doesn't make a backup of the game - it is more or less a physical emulator. If you used it to make a backup, it would probably be a legal gray (personally, I don't see an issue as long as it wasn't distributed).

Morally, I think it is fine. If you own the games, you should be able to enjoy them however you wish (as long as it doesn't prevent people from buying them - although the only way to get classic carts like that is used). You've bought the rights to use the program, and this is one way to use it.

@The people talking about 3DS VC SNES (wow that is a mouthful) - Nintendo could easily pull it off. The 3DS has more processing power than the DS, and the DS was able to emulate the SNES I believe.
