When it comes to the internet, there seems to be a wild west mentality. Anything goes. Laws don't apply, etc.. Late 90's was the peak, with Napster and all that. Ah... what a great time. Anyway, things have been clamped down on a bit more since then. I still get a kick out of seeing people put a message in the youtube description, 'No copyright infringement intended'. Because, you see, that is a magic shield that protects from any and all accusations.
Against my better judgement I checked the link for 2 seconds, but I'm not interested in this mcsupergamer's opinion. I personally prefer people's own thoughts here on the matter.
We could knock some beers back and both scratch our heads over legalese. No lawyer here either. But I do read the US copyright office site for fun
Right within this document, it's stated that Nintendo was claiming the game genie was a derivative work, which stands to reason it would have been a copyright violation. The judge didn't see it as a derivative work, but as some skipping pages of a book, whatever. If I'm missing something, please let me know. But yeah, this all seems a bit different from an LP case.
"Smith compared usage of the Game Genie to "skipping portions of a book" or fast-forwarding through a purchased movie; thus the altered game content did not constitute the creation of a derivative work as Nintendo had argued"
Well, I have no doubt they'll have a pretty stunning show at E3. Dropping online pass is a good thing. I do wonder if they will find another devious way around it.
Wait... the right to create a derivative work belongs exclusively to the original copyright holder, unless they give their blessing to another party to create a derivative work.
How much work someone puts into their project is absolutely irrelevant. Pirates could claim to put a lot of work in their hobby, too. I could put alot of work into scripted commentary along with an uploaded, copyrighted film. Somehow, that entitles me?
No, but some LPers do this AND with pirated software. People should be grateful these aren't the dark days of the music industry sueing everybody. There is little for LPers to gripe about here.
Not quite so, because Nintendo does not support, and frowns upon emulators. Many LPers use emulators, and that's a whole nother kettle of fish. Some LPers not only profit off the IP, but by useing pirated software as well.
Nah, you'll be fine doing it for free. Worse scenario in the world, you hear about it from Youtube. There is generally no beef with LP's at this point, as long as it's at, or post street date release.
I'm sure Nintendo didn't come up with this idea sitting on a toilet. They weigh the plus/minus, and it's impact. Massive legal muscle at the ready, and new Metroid, Mario, and Zelda blockbusters that everyone wants, at hand.
Nes and Super Nintendo didn't need a single LP to fly off shelves. How they market and promote themselves is their concern.
Paid reviewers with subjective opinions leave a bad taste in my mouth, too. Essentially, making a living, or partly, with no basis aside from another party's properties, and hard work.
The handful of actually talented LPers may be able to monetize from their actual talent, with their own original material. But getting up a brand new LP first gets hits because of the video game, the actual substance. Someone else's hard work and property.
I'm guessing negativity would be different if Wii-U was being swamped with AAA third party interest. Then it would be an exciting bonus rather than unknowns filling big gaps.
I just assumed the VC was going to be so spectacular, I was going to get lost in all the titles, GBA included. Disappointing to say the least, but probably my fault for not researching the matter beforehand.
Some things could use work if we're taking everything into consideration. Better browser capabilities, since they bothered in the first place. I don't expect Vita capabilities, but something better. An e-reader is past due. Reading on the 3DS works fine .. 100 Classic Books proves this. And the circle pad could use a grit texture. It's too easy to slip off.
I don't get how people think it's good these games aren't coming to Wii-U. Some people actually do like Star Wars, (american) football and wrestling games.
In seriousness, if we're going to believe this influences people in positive ways, then we also have to take into consideration the bad influences. If it has the power to inspire someone to get off their rump and do something smart with their life, then on the flip it has the power to inspire someone to do something dreadful with their life. We can't on one hand praise, then on the other defend it when cited as a negative influence.
While the original Castlevanias may be great from a nostalgia perspective, I would argue the peak of Metroidvanias improved gameplay in every way I can think of.

Just picking one out here....
"Are you saying artists shouldn't make money off of their work just because they worked off of another person's song?"
Yes, unless they have permission/pay royalties.

It's lovely how when someone disagrees, it's constituted as hate.

No, sorry, it's not mean spirited. In general, I don't want to sit through a video opinion on youtube.

Surprised this wasn't done long ago. Perfectly reasonable move by Nintendo. I imagine others following suit down the line.

Re: Developer Interview: Yacht Club Games - Kickstarter Can Show The Demand for Indie Titles
By all the comments here, I'm wondering if Kickstarter fatigue is setting in.
Kickstarter is going strong in the boardgame world I know, but I'm not sure how it will hold up on a major video game console yet.
Re: Scribblenauts Unmasked: A DC Comics Adventure Set for Wii U and 3DS This Fall
Now I HAVE to get a Scribblenauts game on 3DS.

Re: Wii U GamePad Teardown Reveals Upgradeable Firmware, Dual GamePad Support As Standard
I expect Nintendo to be cloud gaming by their next console. If they roll it out on Wii-U, I would be shocked they were on the ball with this tech.
All my VC hopes will be in the cloud eventually I guess.

I do find it amusing it's in a 'sports' line.
Re: ZombiU Developer Hints at a Sequel, Sort Of
I don't think the game is very good, but I guess that means lots of room for improvement and more stuff on the Wii-U rack.
