When it comes to the internet, there seems to be a wild west mentality. Anything goes. Laws don't apply, etc.. Late 90's was the peak, with Napster and all that. Ah... what a great time. Anyway, things have been clamped down on a bit more since then. I still get a kick out of seeing people put a message in the youtube description, 'No copyright infringement intended'. Because, you see, that is a magic shield that protects from any and all accusations.

We could knock some beers back and both scratch our heads over legalese. No lawyer here either. But I do read the US copyright office site for fun

Right within this document, it's stated that Nintendo was claiming the game genie was a derivative work, which stands to reason it would have been a copyright violation. The judge didn't see it as a derivative work, but as some skipping pages of a book, whatever. If I'm missing something, please let me know. But yeah, this all seems a bit different from an LP case.

"Smith compared usage of the Game Genie to "skipping portions of a book" or fast-forwarding through a purchased movie; thus the altered game content did not constitute the creation of a derivative work as Nintendo had argued"

I'm sure Nintendo didn't come up with this idea sitting on a toilet. They weigh the plus/minus, and it's impact. Massive legal muscle at the ready, and new Metroid, Mario, and Zelda blockbusters that everyone wants, at hand.

Nes and Super Nintendo didn't need a single LP to fly off shelves. How they market and promote themselves is their concern.

Paid reviewers with subjective opinions leave a bad taste in my mouth, too. Essentially, making a living, or partly, with no basis aside from another party's properties, and hard work.

The handful of actually talented LPers may be able to monetize from their actual talent, with their own original material. But getting up a brand new LP first gets hits because of the video game, the actual substance. Someone else's hard work and property.

Some things could use work if we're taking everything into consideration. Better browser capabilities, since they bothered in the first place. I don't expect Vita capabilities, but something better. An e-reader is past due. Reading on the 3DS works fine .. 100 Classic Books proves this. And the circle pad could use a grit texture. It's too easy to slip off.

Other than that, pleased as punch so far.

In seriousness, if we're going to believe this influences people in positive ways, then we also have to take into consideration the bad influences. If it has the power to inspire someone to get off their rump and do something smart with their life, then on the flip it has the power to inspire someone to do something dreadful with their life. We can't on one hand praise, then on the other defend it when cited as a negative influence.

A can of worms, no?
