Sounds to me like the EULA changes are just there to cover Nintendo if they "cause damage" via an automatic update. The main reason they might "cause damage" being that the end user might have modified the system in some way. So basically by agreeing you're letting Nintendo potentially brick your system if you've modified your console. And I wonder why an end user would want to modify their console.....

See I'm usually the one who leaps to the defence of the internet rights crusaders. For example in the case of iiNet vs the movie industry I cheered for iiNet who argued that high rates of TV/Movie piracy was a side effect of crappy distribution. When the media industry disagrees and instead of, you know, giving us a Netflix wants more powers and for ISPs to police the 'nets for them at their expense. Or how all of this Snowden/NSA stuffs makes me uneasy about privacy and security. But in this case? With a gaming console? Where the main reason for pushing back is so that you can pirate content? On a platform where the distribution system is pretty decent?

If it was Nintendo coming down on a workaround that killed region locking? Or people pushing against that more generally? Then sure. But this? Yeah, I'm not going to defend that.

And even then there's no real understanding of any "rights" here. Most of the EULA is supported by the FCC and copyright laws, while some of it is only worded awkwardly. The only users who need to fear this are hackers and modders. Nothing will happen to your console otherwise

People should know by now that if you buy games on a console you're basically renting them. It's not really an issue, but if you want to be free from it then buy a PC and some DRM-free games. If you buy a Wii U and then are surprised that you have to agree to some terms of service then welcome to the modern world.

Has there been an instance where Nintendo has fixed something that has bricked the console for free. (One of their updates for example - console out of warranty).

(I know Sony absolutely won't fix it in that instance and Microsoft will even if it means giving the user a brand new newer console).

Yep, I agree! It's Nintendo's console, and we are all "free" to purchase it and use it as well as "free" to not purchase it and use it if we don't want to. If someone doesn't like the EULA, they can take their business elsewhere. They are free to do so.

In today's world people are free to do what they want with PC's and phones (well, if they have Android and not Apple...) , it's good that there is also a safe environment like Nintendo. It doesn't have to support anything Nintendo doesn't want to - it just plays specific games. It's not an encompassing environment for all your life activities, and therefore Nintendo is free to do whatever it wants with the EULA.

They are free to do what they want. (Which personally I think is stupid - EULA's should have to contain stuff that is actually actionable).

People are free to ignore EULA's. (At least for goods sold in the EU anyway).

Every piece of software and hardware device has some form of EULA. Most people don't read them but they are still there. If you want a EULA free world, you will pretty much have to become a hermit. It is a mass produced product. It isn't some custom made, all original parts product made for one user in mind. Honestly, that is the trade off for having mass produced products. Not a fan? Good luck building EVERYTHING from scratch.
