Ontopic: I think, just as the others here, that the firmware-update & wifi are the problem. All people on a Dutch forum who have wifi off and have the stock firmware, haven't had any problems.
@Magi I agree, but it's a two-way street, and users should still contact Nintendo directly about this issue.
Oh for sure. I guess what I'm trying to say is that there are lots of tools in the toolbox and I think everyone (manufacturer and consumer) have some amount of "responsibility".
perhaps it's like when a ds freezes , but it comes up with a black screen so you know there is a problem. I haven't encountered it because I don't have a 3ds

So far one crash in Lego star wars about 2 weeks ago but I've put like 10 hours into shadow wars and no crashes as of yet. I always leave wifi on as well.

If I was only ever able to have Monster Hunter and EO games in the future, I would be a happy man.
@Magi While I doubt they would notice complaining in forums, but in theory game site admins would and news articles would be written.
It looks like some outlets have picked up on this, the biggest in a quick google search being USA Today. Hopefully it's not something that masses of people will need to send in for hardware repairs. I guess the question is, has anyone NOT gotten the BSOD at this point? At any rate, ninty should definitely know about the problem by now, hopefully!
Someone on Amazon (in a review, not a discussion thread) said Nintendo told them to send their 3DS in for repair. I hope they post again when it comes back to let everyone know whether it solved the problem or not. Of course, it might take a week to know for sure that it is no longer crashing.
I have never gotten the BSOD yet. but at the same time I never played the games where this is an issue and while I do have wifi enabled I do not have street pass enabled. I have also updated the firmware when i bought it.
I can't imagine that all 5 systems I have access to are all broken from a hardware standpoint. It almost has to be a software glitch and one that can be easily fixed with an update.
And it's been over a week now and I haven't had a single error since turning off the wi-fi.
RROD affected more 360's than not in the first generation. This alone is an example of console where you could strike out five times in a row. If wifi is the cause then why rule it merely as a firmware problem? Defective hardware can crash PC so how are you sure a defective wifi card cannot crash a 3DS? The error could be a board safety feature that is triggered by a wifi card misoperating for all we know... Sad but potentially true. We can only speculate until Ninetendo gets their act together and announces the cause. The fact that they haven't is cause for concern.
One more thought. Some people get it and some don't in cases where they both have the update and play the same games. In cases like this the only difference is the hardware and so to everyone saying it's the firmware please explain to me why not everyone is suffering from the same issue?
