I also have Cosmo Black and have not seen the error. I updated on day one, have wireless on all the time, and have logged close to 80 total hours across various games and programs. I know Corbie ran a test across 3 3DS systems for the black screen error. I'm curious to know if they were all aqua.

@SilverBlacktail Back in this thread http://www.nintendolife.com/forums/3ds/an_error_has_occured people had talked about the prospect of maybe it being just being the aqua blue 3DS's that were having the issue but there were some people who said they were having the issue with their Cosmo Black ones too in this regard.

@LunarJade: Ah, so that's not the problem then. I say we just wait until a valid fix is released and stop worrying so much, but I guess it's all in the pursuit of knowledge.

It looks to be the WiFi being turned on with certain games. I think that's something that can be fixed with the update.
I checked with my friend to see if he'd gotten the error and he's only gotten it twice with Ghost Recon on his Black 3DS but he hasn't had it since and he still has his WiFi on. So it might not even be related to the actual problem.I just got the update recently and haven't had any problems so far but I also haven't played much as my classes are taking up a lot of my time right now. My 3DS is Blue.

I updated. Played with my 3DS for about 20+ hours and no BSOD for me. I keep hearing Monkey Ball 3D and Ghost Recon are the causes but I wouldn't know.

To debunk the color as a cause I have a cosmo black 3DS and it happened to me last night. First time and unfortunately i updated my system right away as soon as i bought the system. Going to try Corbie's idea any time I don't need the Wi-fi function.

It really sounds like something that can be fixed with an update (software issue). Since it HASN'T been fixed by an update yet, all the customer service people can do is offer to repair it. Thank you for calling Nintendo and making them aware of the problem though. Whining on the internet doesn't let them know there's something they need to fix.

I have Cosmo Black and it happened to me twice, both while using Streetpass Mii Plaza when I was hiring heroes and they both happened within 5 minutes of each other. It hasn't happened since (this was yesterday and yes, it is updated).

I have a Cosmo Black, and it happened in the middle of the final boss fight on Rayman 3D. The only time.
EDIT:I'm willing to bet it is just the 3DS way of having a software crash. Maybe because we keep them on and running throughout the day? Computers do the same thing, becoming more likely to crash when not shutting down or giving it a restart every so often. So many processes running, ending, and starting, it's probably just not as organized with it's system management yet.

considering an update is the likely cause, an update is more than likely the solution.
Yeah. As far as I know everyone who hasn't updated hasn't had the error yet, including myself.

I've never experienced it, though I have only been playing the three Nintendo made games so far. Most people seem to have it happen using a third party game, but that's just a casual observation.

You'd think there'd be at least a couple of company hires combing over teh interweb looking at reviews, researching improvement suggestions, logging "unofficial" bug reports, etc. This is 2011 for chrissakes, companies should really get to know their consumers better and the internet is a wonderful tool to help.

@Magi I agree, but it's a two-way street, and users should still contact Nintendo directly about this issue. I know that NL staff don't have time to read all the topics on this board alone, so imagine having to scour multiple messageboards!
Incidentally I'd like to echo what Sykotek says — I have an Aqua Blue 3DS and haven't updated, and I experienced the error this morning while opening my diary in Nintendogs.

Finally got the error a couple of days while playing lego star wars. To me its no big deal so far. Its like a system freeze. However I can imagine some getting very frustrated with this if it happens more often. It just might be certain games and I have a third of the launch line up!

Son of a! It just happened to me again on Ghost Recon, but I had forgot to disable the Wi-fi before i played. Was right in the middle of a mission too. Funny thing was once I powered the machine back on I had a SSFIV notification. So this very well could be Wi-fi related.

Not happend to me. I clocked roughly 75 or so hours and havent had a problem yet. Maybe it has something to do with the games? I got Samurai Chronicles and been playing Pokemon black and The World End with You (for the eight time).
