It could happen. Rareware has released a handheld BK game before (Grunty's Revenge for GBA). AFAIK they can't develop for Nintendo home consoles but handhelds are not affected by that ban.

Microsoft owns Rare. Rare owns all rights to the Banjo franchise. And unfortunately Microsoft has closed the handheld department of Rare a couple of years ago, which is why we haven't seen any Rare DS games since Viva Pinata and which is also why we will probably never see a Banjo game on 3DS. Unfortunately, really.
I believe this idea has been proposed several times and the answer is it's not likely. Since Rare and all of its IPs are owned by Microsoft, Microsoft has the rights to publish Banjo Kazooie and Perfect Dark games. And since Microsoft has their own console, it is highly unlikely that Microsoft would support any of their competition.

If we do, it will most likely be on the next Xbox. It's pretty doubtful thet will release a Banjo Kazooie on 3DS, especially when they have smart phones w/ Windows 8 or other portables using their OS.

Possible but unlikely.They have developed for the Nintendo DS, but I doubt Microsoft would allow them to put such a high profile game on a rival console.
My SD Card with the game on it is just as physical as your cartridge with the game on it.
I love Nintendo, that's why I criticize them so harshly.
