@SwitchForce his motivation might be money, but the laws are written so it doesn't matter if the offender earns money or not. That is a common misconception I see repeated time and time again.

Another is that he needs to sue every one. That is also false. He can give his silent blessings to anyone. And it would be super strange if it needed to sue every one, then he would have to play every game, watch every TV show and every movie. And if anyone would slip through, he would lose his rights.

No one can own dance moves. But that isn't what this is about. This is about his likeness. And those dance moves are tightly connected to him. That is the first person I think about when I see them. There is no denying it.

I personally think this is as bad as all other forms of copyrights, they are stifling culture more than helping nowadays. The original copyrights were 14 years, with an option to have another 14. That is more reasonable IMHO.

@mantez It did that years ago. It is also funny to see that NL commenters that usually like copyrights suddenly have become negative in this case.

@SBandy it is called "personality rights" and are most similar to trademarks. I am not a lawyer, so I don't know if it is applicable in this case.

@Vepra Yes, that is true. Blame the copyright system that has gone unchecked for so long.

Time has nothing to do with it. The copyright laws are written in such a way that it is EPICs responsibility to ensure they are not breaching anyones copyright, and any work are automatically protected. In this case, they will have a hard time saying they accidentally created a move in the likeness of a famous move. And calling it "fresh" confirms it even more.

He might not have a case regardless, but time has nothing to do with it.

@LordGeovanni red/blue is not entry level anymore. Old games were hard because arcades needed to be hard to earn money. But even if it was entry level for you, the next entry had a player base drop of 30%. And after pokemon go, the most casual experience as of yet, pokemon sun/moon gained 50% more players over the previous entry.

I don't get all the whining from the so-called hardcore gamers. We are living in the golden age of gaming, we have super easy games as well as super hard games. Why whine over the ones that are easy? Buy another game.

And it is even worse when it comes to this game. Next year there will be a new core game. You can safely skip this entry since it is a spin off.

@ZombieGavinS depends if it becomes an hard or soft brexit. If you want an hard brexit, you can change your laws however you want.

But if you want access to the inner market, you will still be bound by all EU regulations regarding goods, pay almost as much as you have done but you will not have any say in the law making. And you will need a visa to visit EU.

I would guess you can change your consumer protection laws in both cases since it probably won't effect EU citizens in this case.

Giving odds can be useful, but it depends on what the odds are talking about. For example, in fire emblem heroes they give you the percentage to get a 5* or 4* hero in the summonings. But the problem is that you have no idea about the odds to get a specific hero because they can still be any of the hundreds in the hero pool.

Physical blind bags are different in that if you get a duplicate, you can trade it, sell it, burn it... If you get a duplicate in a game, you are at the mercy of the developer if you can do anything about it. Developers can also change the odds on the fly if you buy too little and get to many big names.

I don't have a problem with mature content if it is handled correctly. My biggest complaint is that much of the gory stuff wasn't for enhancing the story line, it was for shock value.

Just because you can add edgy stuff doesn't mean you should do it everywhere. In fact, it is better to be more conservative with it to add more weight to some scenes.

I think two things were a problem this year; pacing and no funny moments. Smash got far too much time, and the other things got too little. I started to zone out halfway through the smash bit. Better pacing would have been better.

Nintendo has had fun moments in their directs. This year was so serious, and it becomes bland as a result. It felt more like an infomercial instead of the big gaming period of the year.

I think the big dragons will try and push for this. If every smart-TV suddenly is capable of having the latest fifa or madden where you only need to buy a controller, why bother buying a dedicated console? Much cheaper (at least on paper) for many.

The big publishers would be happy to cut out a middle man (Nintendo, sony, etc) in the process.

@SmaggTheSmug while that might be an overreach on Blizzards part, they were called pandering to LGBTs/SJWs long before that. While I wrote my post in jest, it was around that time some started voicing their concerns on how they forced 'agendas' down their throats. Just look at how these people are now reacting to Battlefield V... or farcry 5 before it...

I don't think overwatch would have been as successful as it is if they hadn't made such an diverse cast. Diversity broadens the gaming hobby. This isn't a bad thing.

But I am not sure it is an overreach on Blizzards part either. If people start harassing their players outside the game and they can prove it, why wouldn't they start banning people?

@MegaVel91 no, I don't think fair use applies here. It isn't a review, criticism or parody, which are the strongest fair use arguments you can use. It does however limit the market for Nintendo to make and sell their own block, the very reason copyright laws exists.

You don't need to register a trademark, if it can be associated with the owner it applies automatically. The block screams Nintendo, you can't deny it.
