Basically nearly all the DS content that is supposed to use Nintendo Wifi Connection is basically just a few flags changed in the save game that unlocks stuff already on the cartridge.

I thought Pokémon was actually owned by Nintendo, but developed by Gamefreak.
Nintendo probably owns some or all the rights to the series (since they apparently own Game Freak), but Pokemon is much broader and independent from Nintendo than say... Zelda or Mario.

We see this all the time. A quick example that comes to mind is Halo, which is owned by Microsoft and developed by Bungie and now 343.

Nintendo actually invented On-Disc DLC with Pokemon Red and Blue. Mew was essentially free On-Disc DLC. The worst part is that Gamefreak still does this practice and it's even worse now.

there is no such thing as on-disc dlc, if its on disc its not dlc is unlockable, the problem is with companies that lie and try to charge you for unlocking content already on the disc by claiming is extra content you download for the web.... I don't see a problem with what Nintendo did because I don't think they ever claim it was extra content you were downloading it was always clear it was content that you unlock through wifi
