Wow I didn't realize there were so many rules for your guy's school. Good thing when I was in high school I got a good ol' fashioned public education!
Seriously though, look on Facebook and see if there are any clubs already made locally that meet off a school campus and invite your friends. I live in Southern California so it isn't that difficult to find groups like that, but I tend to game alone most of the time anyway on the 3DS and just pick up spotpass at the mall.

Yes, as I mentioned in my first post--he lives in a different country. So, let's stick to helping him start a club rather than extolling the virtues of German law.
EDIT: By the way, educators can search students' bags in Germany if there is a possible, not even a probable, safety risk. So yeah, even over there a teacher can take your stuff.
@Klimbatize not even a security guy in a mall has the right to search your bags in germany. of course in reality everyone believes they would have the right, but legally they do not. only the police has that right if they think it is important for public safety (so in fact they do what they want).
go talk to the headmaster. maybe he has a 3ds too and everything will work out perfectly. maybe just put up poster for after school meetups in a coffee shop, restaurant, game store, mall etc, heck even your own house or a park if you have no other places. pick a day of the week for everyone to show up to.
legaly no one has the right to take away something from you. no teacher can take away your 3DS, phone, whatever.

Meh, just do what you like to be honest. That's kind of what I did back in my school days. If they try and confiscate the device, just refuse and tell them to go away. If you get in detention, don't bother turning up or just walk out. Worked for me all those years ago.
As for how to present it... well, maybe it's really odd where you live, but over here that's not the kind of thing you'd ever need to present to staff. No, that's what happens with things you want to consider as school sponsored, like a sporting event or a local newspaper. A club was always more of a 'as long as you stay out everyone's way and don't do that stuff in actual lessons, do what you like' thing.

Anyways, concerning the bag search thing, it is against the law for anyone to search you without the presense of your parents, and only the police can do that if they are suspicious. HOWEVER, when joining the school you sign a contract to follow the rules in their handbook. So thats that...

@Boldoh: given the risks involved with inviting people to bring expensive electronic devices to a place that actively disallows the use of such (and may well wind up confiscating them), as well as the fact that playing video games has nothing to do with education, you may be better served just organizing a get-together with a group of your friends after school sometime. I'm not sure that a principal or headmaster would have the time to help out with a video game based club, not with an entire school to run.

I asked my art teacher if I can use the Art Centre if the headmaster agrees with the idea and he also said he wouldn't mind supervising over the club.
And with the entire school to run thing, the headmaster spends her time all day in her office on facebook...
Then just pitch your idea and see how it goes.
The worst they can do is decline, and if you think they might, just do as others have said and explain how it is actually a study group as well or something. But some people are saying disrespect authority, that won't get you anywhere, don't do that. And honestly if they say yes then it'll all be over with.
If all else fails, just have it at someone's house or something.

I'd try to pitch it as a game design analysis group. You could bring up that it could help people attain a career in game design from the job. I recommend writing an essay on it, with proper sources and whatnot. The more work you show, the more they'll probably consider it.

Then why are you asking us? I don't get the point of this topic. There is no educational value in allowing video games to be used on a school campus unless all you're gonna play is Pokemon Typing. All you can do is hope your headmaster is willing to allow the devices to be brought to school and is okay with the teacher you've chosen to supervise the 'club'. Just ask them and get your answer.
If you're looking for moral support of some kind, it's not gonna come from me, I'm afraid. School is for learning and interacting with fellow humans, not sitting behind a handheld gaming screen (or a phone screen for that matter). Video games are for after school, and even then I'd be leery of bringing a 3DS to school given how much theft I saw going on back when I was in school, lol. sure, i brought a Game Boy to school, but it couldn't surf the internet or watch Netflix or even play its games in color, and even so I kept it in my band locker (which had a proper key and the added benefit of being in a place where only band members had access, unlike our normal lockers!). I wouldn't want to even pretend to be responsible for having encouraged a friend to bring an expensive piece of technology to school only to have it stolen out of their bookbag or something — god forbid their parents decide the 'club' was responsible and demand you replace the device. I hope your chosen teacher (and headmaster, should they agree) is prepared for that sort of potential fallout.

The point of the topic was to help me gather some strong points to help me out in persuading the headmaster.
I'm not sure if your understanding what I'm trying to say. The club will take place after school. I already sneak in my 3DS some days and after school is over the teachers nor the headmaster really care about what electronics you have on you. If that's your point why this is an awful idea, why are there sports clubs at my school, is sports related to learning in any way?
And you said it there exactly, video games are for after school, we won't be playing during school hours but AFTER school is where the club will take place. And with the theft thing, people check in their phones at the office everyday then pick it up when they leave school, when we need to bring our laptops to school we do the same thing, I don't see what would be bad about checking in a Videogame and then picking it up at the end of the day.
