Update: Nintendo has released an official list of the 11 DSiWare games that cannot be moved to 3DS, superseding this list.
Original post: Nintendo always maintained that "most" DSiWare games would be transferable to the 3DS, but naturally not all have made the grade. According to IGN, these are the 19 games staying put on the DSi:

Whether or not these games will be available to download from the 3DS DSiWare portal remains to be seen, but for now, we welcome theories for why these games are unable to be transferred.

Some are understandable, as they probably include licenced content.
Art Academy though? I bet that's just an attempt at boosting sales of the retail version.
I hope they can still be downloaded from the eshop since I was going to get Eartheorm Jim. If not, then I might just get it on vc since the only improvement on dsiware seems to be a minor graphical improvement and I was going to sell my dsi after the transfer.
Compare this to Sony's problems and this is a tiny list.
I'm surprised about Flipnote Studio. Glad to see that Mario vs. DK and Dr. Mario can be transferred.
I can assume that some like Art Academy, Asphalt, Soccer and Sudoku all have DS or 3DS counterparts. Flipnote and the browser get a special 3DS one. No clue about the others.
Hmm, most of those have DSi camera functionality (except the sudoku and Domo games), so maybe thats something to do with it. Then again, if that was it, Warioware snapped wouldn't be transferable... hmm
Well, they said they'd be making a new Flipnote Studio for the 3DS, so the fact that the DSi version doesn't work isn't surprising.
Similarly, there's already a new version of Asphalt out for the 3DS...

Only 2 games/apps won't transfer over from my DSi. Oh well.
I wonder if there will be a special Art Academy app on 3DS. There's room for improvement and I'd love to see them incorporate digital art like Sketchbook Pro.
only affects me with flipnote studio which mkes sense and asphalt but the rest i dont care about and that gives me 18 games
I don't own any of those except Flipnote, the browser, and Pro-Putt Domo. Two of those were free, and Domo sucks, so I'm good.
I can see them making a new 3D Flipnote and since they are going to do a Virtual Console they might put Earthworm Jim on there or make a 3D version. the others are probably just so you don't get rid of your DSi. But I'm glad to see Photo Dojo and DR. Mario will be able to transfer
So I'd lose Asphalt 4, Sudoku Student, and that crappy Soccer 09 game, along with FN Studio and the browser. Not bad considering how many other (and better) DSiware games I have.
I hope I can download Art Academy at least.

My favourite thing about all this is I can transfer all the Ware from my DSi AND DSi XL to my one 3DS. Props to Nintendo for making it possible

Is it an all or nothing thing? I thought you could transfer what DSiWare you wanted, ie. pick and choose it? Flipnote and Asphalt are on my title screen on my dsi menu..I pick up and play them to this day

While a few of these do make sense, namely Flipnote and the Browser, the rest have me a bit confused. Pinball Pulse (an excellent distraction) and Earthworm Jim in particular. Of the pay to purchase titles, I only own Real Soccer 2009, Pinball Pulse, and Asphalt 4, of which ony Pulse has much chance of being played again. So my losses, such as they are, remain minimal.
I am however, a bit dissapointed that Flipnote Studio has been denied transfer. Although I've not used FN in roughly a year, permanent bans put a bit of a damper on this, I was interested in tinkering around with it on my newer-shinier-bigger 3DS. (There's also the small matter of it being a new MAC address) But, FN Memo should be worth a try. Hopefully with fewer spamnotes, softcore h****i, and cyber relationships (as Steven Tylerwould say, Dream on), so this is more or less a moot point.
All told, the bulk of my DSiware library will make the jump, all $200+ of it, and hopefully it will get a new lease on life from the circle pad, larger screens, and un-glitched cameras.
Also, to the theory that Real Soccer and Asphalt were cut to improve sales, look at games such as Tetris Party Deluxe, Puzzle League, and NFS Nitro-X, all of these have full-priced cartridge brethren, yet they were released at $20 less anyways.

@30 I also thought some camera games wouldn't be transerable, although 3DS has a frontal camera it isn't exactly at same position, and those games that recognises your face probabily wouldn't work properly. But hey, I suposse I was mistaken, and thats good in this case =)
And for those all who are complaining about Flipnote Studio being in this list, Nintendo said recently that a new Flipnote Studio kind program was being programmed for 3DS, so don't be worried for now.

I don't think the camera would be an issue. I have Assassins Creed and Hidden Picture and both work fine with the 3DS.

Figured the browser and flipnote wouldn't come over, since they were free and new versions have been confirmed for the 3DS.
Can't really figure out a common thread for the others. It's a shame that Pinball Pulse isn't coming over. I really liked that game. It's the only game I have that won't transfer though, so it's not a deal breaker for me.
As David from "3DS Blog" some of these games could be unavailable because they want sequels for their games. Which explaines Let's Golf, The Internet Browser, and Flipnote Studios. Although Sudoku Student, Master, and Sensei may relate to the recent defunct of Hudson (the shop will soon be able to play turbographics games.)

Based on that list, I'll lose Pinball Pulse and Pro-Putt Domo. I can't say I'm too sad about the Domo game, but Pinball Pulse is an amazingly entertaining experience for any pinball fan. I really wanted to take that with me.
Can't complain too much, though. I'm only leaving behind two of my many DSiWare games.

Nintendo probably won't make a "3D FN Studio", but they might make a "2.0" version or something. The problem is you drew on the touch screen, it appeared on the top screen. Now the 2 screens are different sizes.
Flipnote is probably not a big issue, since that's freeware (am I right). You could download it again for free in the 3DS store (if it's available there, of course).
I've always planned to keep my DSi, so this affects me none. I wouldn't have wanted to play my DSiWare games on the badly scaled screen anyhow.

I really wish Pinball Pulse would stay. They'll probably just remake it again with 3 or 5 tables instead though. I still doubt it would be comfotable playing Locksley's Lineup with a camera that's off to the side of where you're looking.
Exactly, @61. My DS games look great on my DSi XL. I feel bad for anyone who traded in their DS for a 3DS, the DS/DSi games look awful on the 3DS. I plan on my DSi games staying on my DSi XL.
I actually have 4 of those :/ so it bums me out just a little, but Super Mario Land on launch day makes up for all of it! :3

The save data is linked to/in the game, so normally you transfer it together.
Dsi browser makes absolute sense, I mean who would want to carry over an Internet browser when you already get one in the update. How do you even carry them over, and will it erase the games from the dsi

Of all my DSiWare games, I play Sudoku Master the most... best Sudoku game on DSiWare... that sux. Also, the Pinball game is great, too...

Let's see:
Asphalt 4: Elite Racing — Played it, it was a decent arcade racer, beat it, and erased it early in the DSiWare's life, so this is of no concern to me
Flipnote Studio — This was free anyway... it'll likely be free again on 3DS' DSiWare which is actually what I was anticipating... a re download which is fine at the cost of free Not to mention that Miyamoto talked about a Flipnote Memo follow up or whatever.
Nintendo DSi Browser — Duh... The same day the superior 3DS Internet Browser is unlocked, so no love lost.
Oregon Trail — I wasn't planning to transfer this one anyway as I'm giving my DSi to my mom to play this game... one and done for me.
Pinball Pulse: The Ancients Beckon — A regular fav of mine but I had already decided to part ways with it as after opening Pandora's Box, there was nothing else to do and I was bored with it though I love Pinball. Can we have a Pinball Pulse 2 Nintendo, what's up with that?
To answer the article question, The only correlations I can draw are:
1. Asphalt and Oregon Trail use the camera feature, so maybe there was an issue making them work on the 3DS, idk. Also these 2 games had a decent a modest amount of load time, but then again, so did Alphabounce, so, that theory doesn't hold...
2. DSi Browser didn't make it because Nintendo said "What's the point?" and I agree... that's most "likely" the reason for that
3. Flipnote Studio... either Nintendo is making room for the Flipnote Memo and said again "What's the point?" maybe it's how it's data is saved between the system and SD card... who knows?
It's all speculation, but at least a couple make sense... others probably were coded in such an offbeat way to make them work on the DSiWare that they wouldn't cooperate with the 3DS... the world may never know...
We should sue them.! Only because they didn't warn us when we purchased these games that they may not be transferable to future systems. That should have been in the disclaimer for when we purchased. can you imagine if they did disclaim that? How much less those games would have sold?

I think the Domo games not being transferable have to do with the being a single GBA game...I think that's a strong hint the the GBA is coming to the 3DS.
Looks like I was fortunate that the DSiWare games I downloaded are not listed. Of course I have Flipnote Studio and the DSi browser, but I can still get Flipnote Studio downloaded free on the 3DS anyways.

And she was not in the firing squad lineup. I rejoiced! But the face of Jim on my SNES copy of Earthworm Jim 2 is scowling more vigorously than usual...!
I wonder why Oregon Trail can't be transferred. I don't think it's because of the camera though, since there are other Gameloft games that use the camera that aren't on this list.
It's too bad Art Academy can't be transferred. I still use it.

I read this site fairly frequently, but almost never log on to my account here. So far you're one of about 2 flipnote users I've recognized (shows what I know, ha).
You overrate me though, I never did much in the way of original art. Aside from my optical illusions / scrolling box art, most of my flipnotes were just Japanese imports, back before Japanese imports became trendy.
Because of that, I'm alot more interested in Flipnote Memo as a producer, instead of leech, than I ever was for studio. While my optical illusions looked great (and designing them was fun as well) the possibilites of using 3D to add an increased layer of, literally, eye popping is extremely interesting. (by the way, my gmail is aceofpandas if you want to contact me)
As far as people complaining about how DSiware will look "bad" on the 3DS screens, I've yet to notice enough graphical loss from stretching/scaling to be bothered by it. In fact, I find the circle pad much more comfortable for day to day gaming than a D-pad. Besides, the resolution can be kept at the DSlite sized screen to prevent the now "fuzzy" graphics from upsetting your eyes.
Then again, I've never judged by graphics, because they don't interest me as much as other elements do.
