That looks pretty real to me. I don't think anyone would go through that much trouble to make a fake dev kid that looks very real.

2 or 3 3DS devkits I've seen come and go on eBay. Every time, they were legitimate, but without certain hardware or software or something, the only thing they could do was play DS games. /:

I dont know, after playing my 3DS I just find it hard to go back to the analog sticks. I find that I have better control with the circle pads than the sticks. It almost feels to me like the circle pad combines the best of the Dpad and the best of the stick.

The sticks are better for fine controls, but otherwise I find it annoying the degree to which you have to move your thumb around, and the way they tilt annoys me and can even be painful when you have to keep holding right in a platformer.

Why would you use the joystick on a 2D platformer? Just use the D-pad!

Circle pads work for a portable console like the 3DS. If the 3DS was more like the original Game Boy advance (coughsonycopiedthatcough), it would have normal analog sticks.

No, it's probably not legal. Almost certainly whoever originally got that dev kit from Nintendo had to sign some papers that would forbid resale with Nintendo's permission.
I remember reading last year about a guy selling a devkit for some Nintendo console (can't remember which) that he said he got in a liquidation auction for a studio shut down by Activision (I think), and either Activision or Nintendo demanded the console be returned (I'm leaning towards thinking it was Nintendo that told ebay to take the listing down, claiming the console was legally Nintendo's property, and they only loan it to the developers).
Personally, I just want to see who ends up with it. Because while Nintendo can take down an eBay auction, it could be pretty hard for them to stop whoever ends up with the dev kit messing around with it and seeing how it works.
Heck, if this gets into certain people's hands, it could be the best/worst thing ever for the console...
