Wanting to prevent further arguements about Earthbound VC release when uncalled for, I decided to bring the discussion here and it will stay here. Everyone may use this thread as long as they follow the forum rules and stay on topic. I'm not trying to segergate you guys on this.
Well, once this thing dies out all the newcomers to the forums after it dies wont go looking for this thread to talk about Earthbound and will just think, "Hey, maybe they know why Earthbound hasn't came out on the virtual console yet. Maybe I should post a thread about it..." So, I don't think this thread is going to help much, be it official or unofficial () I hope to see it some day though, I see it being released again in America before I die (from natural causes, not if I die from an accident of some sort next week though, God forbid )

I can guarenteen you that Earthbound will never come out, some of the music is stolen from other companies and stuff, if Nintendo released it they'd get their pants sued off. Starmen can even confirms it!

Wait, didn't Mother 3 have some copyrighted music also, and didn't Nintendo sell the soundtrack to that game on iTunes?

You have an good point, but the game wasn't released in Japan. But the point is if Mother 3 can get away with similar musics, Earthbound might too.
Which directs my post to Digiki's response. If LuigiFreak is correct and you can pay for Mother 3 musics on ITunes and it has similar musics, it means that Nintendo may not have that bad of an legal issues at all. On top of that, Nintendo didn't outright steal musics from companies, some were just similar to original musics. It's not "stealing", but more like "pop culture turned into 16-bit", which is what Earthbound is about. Of course, I just mentioned another problem, but it can't nearly be as bad as the musics.
I could go on, but I think I've said enough for now.
Mother 3 has a different soundtrack. There are some remakes of Earthbound songs, but for the most part none of the problematic ones, that I recall. Only two exceptions I can think of offhand. The first two seconds of the Batty Twist is the Batman theme. They could easily have removed this on iTunes. I have no idea. There is a very short remake of the song from when you wake up in the hotel in Earthbound that takes its tune and progression from the Beatles' "Good Morning, Good Morning" (not sure if that's the name of the song, it's just the words they're singing at the time). I can't remember if the remake makes it as obvious though, and I unfortunately lost my completed save files, so I can't check the sound player since you have to unlock songs. But overall, I do not think Mother 3 has the same issues, at least not to the same extent. Earthbound, however... I can buy that some people are tone deaf and can't tell for most of the songs, but some include actual samples, and that's not something you can argue against. They're there, and you can only miss it if you're covering your ears once you are aware of it.
Of course, you're both missing the fact that Digiki was being sarcastic in the first place, but since you brought up the topic of M3's soundtrack, I thought I'd chip in. Then again, I'm the last person you'd want to ask about pop music, so there could be references in the game that I'm missing.
Mr. Itoi said that the game WILL come out in Virtual Console, and such is good enough for me!
By the way, Nintendo of Nihon does not want to allow alterations to Mother 2 for Virtual Console release. I wonder if such is because Nintendo of Nihon does not want the fans to go all "YOU CHANGED THE GAME, AND NOW YOU RUINED IT!! EARTHBOUND WAS PERFECT!!" for infinity.
