Topic: Game video taken down for having criticism

Watch the whole video. This is not the type of thing I try to get into but I guess even for me this feels like the last straw because this is perhaps too important to not watch. If you have any interest in anything discussed of course, I don't want to put this on the same level as national tragedies in terms of importance, this is not anything like that at all. You could argue it's not important but I feel it is, if not for the exact scenario this is describing. If you have any interest in gaming and the internet, I feel this does and will continue to be an issue worth being reminded of though and at this point, this video needs to be spread everywhere.

ugh

especially considering TB is one of the few big time youtube gamers to actually put thought and effort into his videos. From my understanding at least, he has more influence than most game critics.

The one problem I see is that he uses "free speech"...despite the fact that the right to free speech only protects us from the governments. Youtube however is not considered a government and can enforce certain rules despite legality. While the legality is still in question, the poster cannot claim legal rights in this scenario. Hence there is quite a bit of grey area surrounding Youtube's policies. As to whether or not it can stand in court is still up in the air though.

I am not however endorsing and justifying this bad abuse of Youtube's policies.

I've seen this before even on Nintendo Life. Some developers don't like certain reviews and resort to bribery or bad publicity to promote their games (well not really).

Youtube is an American company, as such they fall under American copyright. This clearly falls under fair use and he should contact youtube. If they do not act, they are actually abusing the copyright system.

Free speech is not only about individuals vs the government. Why on earth would you think that?

Because unlike most people I understand the first amendment. It doesn't protect you from private companies or other individuals. Aside from the government, it doesn't really mean much of anything.

While he certainly overdramatized it a bit, I do understand what he's saying. This dev is very childish about dealing with critique, and it's good that the issues with Youtube's copyright rules are going to be brought in the light soon.

Freedom of speech is not limited to the United States

The internet is a giant gray area regarding copyright and fair use though, and as TB said in his video, the laws haven't quite caught up to the technology. Still, I think he has very solid ground to dispute the copyright claim with YouTube.

I saw the video yesterday, and I'm completely with TotalBiscuit (I respect his opinion, normally, but this was something else).

But Youtube's gonna Youtube. They won't change a damn thing.

(I was aware of his run in with SEGA, but on watching this video, it only just sunk in that they were actually taking people's youtube pages down - ruining their livelyhoods just so their new PSP game can appear at the top of the Youtube search. Despicable!)

To be completely fair, there are no rules to posting on the Internet, and there are no rules to moderation on the Internet. But, I do agree with pretty much everything this guy has to say.
