@Bliquid easy to read and easy to interpret at face value, which is suggestive that Nintendo are/or would be using this as an excuse. After all, providing a reason for something that hasn’t happened yet is typically suggestive.
Whether you stated they did or would, the same underlying notion is there. Personally, I don’t see Nintendo using this as an ‘excuse’. As a company and based on their typical behaviour, they are much more likely to say nothing at all moving forward or eventually find, acknowledge and fix the issue.
@Marioman64 that’s correct, however games can be installed on an SD card and perhaps the back-and-forth between game data read/writing and save creation or updating can cause the issue. It’s essentially like two partitions talking to one another.
@retro_player_22 I’m not sure of USA law on distribution of ROMs but in the U.K. it is illegal. Owning a ROM is not if you own the original medium it was shipped on. This is because under fair use, emulators provide a means to play the content which isn’t easily accessible due to original means ceasing. But even then you can play a ROM/ISO even if it’s brand new. But I digress, distributing ROMs for profit or not, is illegal. It’s piracy. The copyright is owned by Nintendo and whichever company owns whatever other games have been provided. A company like Nintendo for example, wouldn’t authorise this even if you disregard the fact that they distribute their software via their own hardware. They would want their own counter-piracy protection measures in place.
Brand SoujaBoy or whatever the brand is, is signing a contract and taking accountability for any infringements by association. Totally sue-able without a leg to stand on. I haven’t even mentioned the use of Mario and GameBoy form factor and likeness.
This is way blown out of proportion. It was unintended offense, not to belittle it. So to boil it down to its core, it wasn't done in spite or with racial intent - essentially it was innocent by ignorance/oversight. So, cool it was removed in hindsight - and if it wasn't and if it then unintentionally offends people, they can choose to respond to that how they want. Offense isn't entitlement, but that doesn't also devalue the feeling or notion. There isn't a binary rule to the matter.
For context: The offense doesn't come from the feather but to which the image the feather is associated to. A quick bit of reading tells me that the issues with depictions like this lie not in the image of a Native Americans but in the connotation of violence with the Native American image. This feathered image is of an attack animation and one that came from a game that depicts that stereotypical issue.
For the record, I am neither upset it has been removed nor would I be upset had it be included - for the reasons i opened with. If I had to have a sided opinion, I would be inclined to not expecting it to change, again because of the reasons I opened with outlined above. Keyboard warriors galore on both sides, balancing on the hypothetical.
It’s such a shame that gamers today see these kinds of things as pivotal in their experience and enjoyment in a game. It ties into the boom of social media and the narcissistic need to show everyone every little thing. Don’t get me wrong, I like replays to show mates from time to time but if it isn’t there it doesn’t take away the purpose and playability of the game.
Then again, re-playing the same loop of gameplay through ‘seasons’ with addictive additives baffles me a bit.
@SLIGEACH_EIRE There's no telling how big the file for the update will be, but that doesn't determine how much storage space it would take. Much of the data would more than likely be replacing redundant data already embedded into the system files.
I can't imagine it being more than MB's big. Technically, it could even be streamlining the current OS storage, unlikely but who knows. Either way, if you are a physical game owner, the storage gets you by until you choose to add to it. It is the right decision, lower costs with lower storage that is cheaply upgrade-able by the choice of the consumer. IT comes with a standard entry amount of storage when compared to leading Smartphones companies -Apple and its iPhone 7 is a great example.

You come across a bit tetchy and have assumed about someone's intentions based on a generalised statement. Why not discuss the game with weighted objective analysis and opinions to back up your own, rather than pick at people directly and unrelated to the topic.

I think the idea of 'new' stems from the fact that it is in essence a hardware revision with a more powerful processor. Much like how Google or Amazon name their tablets the same name despite Subtle changes from year to year.
