The Switch was doing just fine till today. It will play while docked or plugged into the wall and says charged 100% but as soon as i unplug it, it lasts about 5 mins sometimes less a big red battery apears and the screen goes black. I can push home buttton- it comes back on still says 100% and goes off. My suspician is the battery is fried so it only powrers up and down. Please help Nintendo are not reponding to my calls or emails.

Yeah it does does get quite hot, the store is being off with me saying they want some in writting from nintendo to determin if its a hardware of software fault because i can physical boot it up.

That's stupid. its obviously a hardware issue, especially if it gets really hot. and besides, they should be able to refund it anyway if you have the receipt if it's a hard ware or software issue shouldn't matter if it's still a defective unit, I've known a couple people who refunded their switch because of the joycon issue before everyone knew is was a hardware issue. The store shouldn't withhold a refund just because they need confirmation, I've never heard of that before. Is there another store chain nearby you could talk to?
@chr1s984 What shop are you dealing with? They cant demand any of their fairytale writtings stuff from Nintendo, you have a valid warranty and it doesnt matter what the issue is - it doesnt work, so return it to them, tell them to give you a new one or full refund and you can remind them to let you know, when they get some writing by Nintendo explaining the root cause.
Other than that, Nintendos poor choice in manufacturing quality has led to various issues and the battery one is also one youre not alone with.
By your description, I would also pretty much guess the battery is fried because it would fit to the symptons. To exclude any sort of freak-accident-hardware-malfunction you can try charging it with an external battery and see if its any different (most likely no).
@KeatonTS to top it all off, i even took out the extended warranty and they are still being funny with me. Ive just read online that Nintendo charge for all battery replacements. I will be seriously be having some serious words with them if they ask me for cash for something ive only had just over a week.
@chr1s984 hm, I'm not familiar with game UK but I've heard about them. is there someone higher than a regular representative you could call and talk to?

Yer im gonna make a few phone calls tommorow as everyone is shut today, i've sent nintendo another email saying this is my second attempt at reaching out to them. If i get no response from game uk, Nintendo (EU) or even Domestic and General the warrenty people im gonna box it all up and take it back to the retailer.
That's what I'd suggest/do from the start if the retailer has any stock. screw talking to them if they're being finicky. if the retailer has stock, try to return it for a new one or refund it for full price if you can while you can.

I've done a course on consumer rights & you're well within your rights to get a replacement & it doesn't matter whether it's hardware or software. The only thing that would invalidate your claim is if you've altered or damaged the console (outside of your extended warranty).
As the article that @Enoch72 posted, it's illegal for them to claim they do not allow replacements/refunds via signage... of they try to claim this, ask to see this in writing and take a picture.
