Some retailers sell games earlier than the official release dates (e.g. I got Tatsunoko VS. Capcom one day before it was officially released) Are they allowed to do this? If not, is there some kind of punishment if they do it anyways?
It can seriously harm retailers' relationships with publishers and suppliers. FFXIII had a very strict street date that was broken by several UK stores (including CEX) and I would assume they would see consequences for such a serious breach of contract.
