People don't understand this doesn't just ban it from online play, it totally makes the console unusable. No offline play. Nothing. In Europe they're only banning them online, because they know the EU will come down on them like a ton of bricks.
While I agree Nintendo should be allowed to protect their systems from piracy, this system is only going to harm legitimate consumers. And for those saying Nintendo doesn't get anything from 2nd hand sales, they get income from the games that buyer will purchase. That's how the console market has always operated. Consoles are sold at a marginal profit, or even a loss, which is recovered through software sales.
