@SirPrimalform It doesn't matter what a third-party does, no console manufacturer ever has allowed the use of playing backups. Dump your own games, but you will need some other means to play them.
@Amatossy The problem with that is emails are infinite, which means the ban has no real teeth, pirates will just sign out of their real account, sign in with a throw away account then play unauthorized copies of games, it doesn't matter if their account gets banned because they will just make a new one.
Banning the hardware is a lot better because unless the person pirating is a billionaire who just doesn't care and can buy a new switch everytime, the piracy stops. And banning your console isn't bricking it, you can still play any games you have downloaded, and any games that are fully on a cartridge.
Brazil's consumer rights watchdog will lose this, they're arguing about something they assume they have, yes the users have rights to the device, but not the services that the device connects to. The district difference is the product is the hardware, not additional services on the hardware. Yes you can't use a keycard type game once your banned, I could also argue you can buy a serial key to a game online for a system you don't have access to, are you going to sue them too?
Also those who argue they are using the mig switch to play their own backups, no console in history has ever allowed the user to play his or her backups on original hardware, why would it be the case now?
This lawsuit was dead on arrival, if they win they would also be able to go after Sony, Microsoft as well. It's not going to happen, and even if it does, Nintendo just pulls out of that market.
