What I would do is make a separate back up for the new 3DS's micro SD (if you have a reader or an adapter). Do this back up first before doing the following step in case something goes wrong.
Then completely erase it clean and then move the folders from the hard drive to the new microSD as they were on the old SD. Do NOT merge the two SD cards together
This, save 2 files and only play with one. If it doesn't work then you can always go back to what you ended with before this process.

@Spoony_Tech - I haven't tested them all but so far the first 4 carts have been Bit.Trip Saga, ACNL, LoZ:OoT, and Etrian Odyssey IV and all of the save data is saved on the carts so I've lost nothing.
As far as SD card use, I've redownloaded all my software so that's something right there. I'm going to move everything to the hard drive, erase new micro SD card, transfer old SD card contents ASAP.
None of my Save Data has transferred no matter what I do. Thanks for all the suggestions everyone. I'll just bite the bullet, at least my cart data is still intact.
EDIT: Not even the pictures showed up on the New 3DS. They are still only visible on the old one.

I was desperate) website, they had bundled the Red one -the one I wanted anyway- with the two games that I actually wanted as well. The website says it wouldn't be available till the 25th, so I wasn't expecting it to arrive today! I'm a happy guy, lemme tell you. Loving everything about it, and no one will tell me different! How come the new 3ds xl has 28000 blocks with it's 4gb micro sdhc card and the 2ds which i also own just has 15000 blocks, which also has a storage capacity of 4gb in it's included sdhc card?

I've seen you ask this before. Didn't you say you had a pre-loaded game on it already. My daughter's 2ds has 28,000 blocks so you need to check what's on yours to see why.

Once again blame the transfer process and not the system. You have to do this no matter the system You transfer to. If you upgraded to a regular XL Its the same process.

The transfer process IS part of the system. It's all one big crappy entity. If the old XL was this sensitive then that handheld sucks too. No one is going to convince me that everything is "all good" in this situation. New 3DS XL has been a waste of my time and money thus far. I'm glad for everyone who had a successful transfer but I feel really bad for those who lost everything digitally, myself included.

I haven't returned anything and I don't plan to. I just would not have upgraded and spent my money only to have everything erased. Thousand's of gaming hours just went down the crapper and for what? Super Stable 3D? What a joke.
EDIT: For the record, my save data on my NES cartridges is still intact. My original LoZ save data, my Dragon Warrior data, .......cartridges from 25+ years ago still have their save data intact, - but nintendo can't provide a 100% fail safe transfer process for it's newest handheld device? You almost can't make this stuff up.....
