If the age on your Nintendo Network account is under 18, it automatically blocks you from viewing rated M games on the eShop. And I don't think you can disable it. I don't know what effect it has on retail games.
In terms of raw gameplay, the 3DS version is the best one:
+crouch-walk
+3rd-person aiming
+Circle pad controls all types of movement, no switching to D-pad for extra sneaky
+best interface (map always visible, quicker camo changes)
+best control scheme, even without Circle Pad Pro. Older versions of the game used a button for shooting, a button for attacking/CQC, an action button, and aiming...the 3DS version streamlines all of it into the shoulder buttons like MGS4, way way way better

The bad thing is the framerate, which doesn't look so hot on its own but is atrocious when compared to the HD versions. All told though, I love it just because the control scheme is so much better than any other version, and its portable.
It's a bit of a shoddy port but when you start to get into it (with a CirclePadPro) it's fine. 90% of the game doesn't really need a brilliant framerate as you're mostly playing by tactics as opposed to reaction time.
