December 26, 2011 Update: As of about 12:30 A.M. CST today, I can confirm that Pinball Pulse is in the North American eShop, but no titles other than Pinball Pulse.
This is the current list of DSiWare games that (at the moment) cannot be transferred to the 3DS or purchased on the eShop:

At this moment, both Art Academy games, Pinball Pulse: The Ancients Beckon, and Earthworm Jim, which were previously not able to be transferred, are now transferrable/available to purchase in the eShop. So, while it is possible that the games on this list will become transferrable in the future, it's also possible that they won't. (Last updated: Dec. 26, 2011)
were those the only ones out of the entire library that won't transfer? if so, no problems here (i think i just have the Domo games, lol)

Why not Art Academy? I wonder if that also means you won't be able to download it? I know a few people who are big fans of AA, but sold their DSi to help pay for a 3DS. (Glad I'm not one of those who sold my DSi)

No Art Academy makes no sense, that would've been fine on the 3DS. My only guess if they are going to me a 3D Art Academy and simply want more money.
I'm glad most of the good DSiWare made it, but I'm not impressed about Nintendo's own laziness and possible greed.
Actually looking at that list, it's most Gameloft and Nintendo games. The words greed come to mind even more so now. 3D Art Academy, 3D pinball, 3D Let's Golf. Yeah, you get the idea.
All that matters though is that Way Forwards games are making it through.
No offence taken: IGN is a massive website with full-time professional staff and we're a group of passionate volunteers doing this in our spare time.
What? But there I was thinking there was an actual Nintendo Life Towers and you all clocked in every morning to play games and review them and produce articles then clock out again every evening to go for a drink together after a hard day's work on the site.

if Nintendo were playing the greed card, they'd've made damn sure none of the Art Style titles would've been transferable, as well as stuff like Shantae and Cave Story. there's gotta be something else going on with those particular titles, whether it's licensing issues, something that's up with the publisher(s) in question, or the games just won't play right on the 3DS for some reason.
Does this mean you they won't be on the eshop as well or you just can't transfer them?
that's a good question. if it turns out the titles aren't available at all for 3DS, the kinda random-ish nature of these untransferable games would make a lot more sense :3

Out of those I only own four including Flipnote and the Internet Browser, and it is safe to say that Asphalt 4 and Real Soccer 2009 will not be missed.

Shantae and Cave Story aren't made by Nintendo. Art Academy is. I could be wrong, but if we see an Art Academy 3D then I'm right.
Gamelofts games I imagine is just laziness. I imagine you have to reprogram a little to get it to work on the 3DS and they didn't bother. I doubt it would be a licensing issue since these games have been already rated in their appropriate regions.

why would that automatically make you right? i wouldn't be surprised if they had another Art Academy title for 3DS in production for quite a while now. for all we know it could be some kind of internal issue with how it handles on the 3DS, and why bother recoding the game entirely if they've got another version up their sleeves?
there's also plenty more Nintendo-published things that aren't on that list, like the clocks/calculators, and perhaps most importantly Aura-Aura Climber. if they were really going the greed route, they'd'a kept all of their offerings from being transferable, not just these few.

that's not the licensing i'm talking about — i meant stuff like Domo in particular where maybe the devs/publishers paid for the rights to release a game based on that character specifically on the DSi (without taking into account that it may be possible to sell the game on another console), and the games perhaps sold so poorly that it wasn't worth pushing for the rights to release it on the 3DS as well? idk, it was just something to consider :3

I was actually expecting cave story to be one of these titles due to the 3DS remake but its good that there will be the option if some people would rather get the cheaper, original from dsiware.
