Topic: Gamers Bill of Rights

I've always been big into politics. I love debating it and explaining it. In my opinion, the few pages written by the Founding Fathers of America called the Constitution is greatest thing written since Moses came down with 10 short sentences on two stone tablets. The defining piece of the Constitution is the Bill of Rights. These rights aren't given to us by anyone, these rights are what we as people are given just by being alive.

Taking that and the recent topics of 3rd parties leaving the Wii behind because of sales caused me to think on how we as gamers are not only taken advantage of but also looked down upon by these companies. If you agree with these and can think of any others, say so. If you disagree, say so and why. This is a work in progress and when it is done, I plan on sending copies to all of the game companies, magazines and websites that I can find. It's time for the gamer, the customer, the people to be heard.

1) No game shall be released that requires the patching of a bug on day one. If you release a game that needs to be patched the customer shall be allowed to return said game for a refund or replacement without question.

2) The price of a game shall be based on the amount of time and money spent on the game and the amount of content in the game. If you sell a game that is focused on micro transactions after purchase to enjoy the full game it should not be the same price as a fully realized game.

3) In the event of a sequel if the game does not contain the protagonist or antogonist from the preceeding game or does not build upon the storyline from the preceeding games, give it another name. DO NOT try to trick people into buying a game because of the brand recognition of a popular game. This does not apply to games that take in place in a shared universe to tell stories that follow the same standard rules of said universe, no matter if it is past, present or future.

4) If an updated version of a game is not a true sequel, price it as such.

5) If you create a game that is in a genre that is unproven or passe, do not blame anyone for low sales other than yourself.

6) All gamers, no matter if they are "hardcore" or "casual" deserve the same respect from not only the game companies, but from the rest of the gaming community.

7) The system of your choice is not better or worse than that of someone else.

8) All games shall have a beginners difficulty option. Every game made is someone's first game.

9) An option for single player offline play must be included in every game that is not labled as a MMORPG.

10) There shall be a minimum of 1 year between sequels to game series, including side stories and spin offs.

I like this, but I don't agree with #3. Just because it's not the same characters doesn't mean it's not a sequel. Take Resident Evil 2 for example and Final Fantasy after Final Fantasy. It's a good thought, but there should be an asteric beside that or a more flushed out idea for that one.

Ok, I clarified #3 with this (which I meant by continuing a story, sorry)

I rather dislike this idea. I appreciate you trying to use the Bill of Rights to create something that is relevant in gaming, but for the most part it doesn't fit. With the exception of the first "right," your Bill of Rights is more of a collection of statements, potential laws, and things that annoy gamers. Other portions of your "document" are rather strange as well, especially Number 8; it sounds more like a tyrannical law than a right. I realize it is just your opinion, but I'll be one Congressman that does not approve of this document.

I like this idea, but if this gets passed (which looks like never due to Jack Thompson's BS he's throwing around), companies will bend these rules to their liking and keep doing what they've always done. I think we'll need to have WAY more paperwork than a ten commandments of video game making.

I don't agree with number nine. Just because something is an online only game does not mean it has to be a MMORPG. MAG, Warhawk, Counter Strike, all shooters, not RPGs.

As I said, this is a work in progress. Also, this isn't something to send to Washington (they have enough on their plate lol) this is just what we as the consumer deserve. A lot of the gamers and game companies forgot that we are the reason they are in business and they should be thankful for us, not the other way around. Like I said, if you think of something add it. If I worded something wrong (such as #9) change it.

There's nothing official about this, it's nothing legally binding to it, it's just a way to think about what we should be able to expect when we put that box on the counter and take it home.

11) All games shall include at least one bishounen character, to appease fangirls. Two is recommended, one protagonist and one antagonist, so that the fangirls have the opportunity to create yaoi of said characters.

I'll pass on #3 and #10. I'll suggest one thing though:

  • Third-party accessories, in particular controllers and memory cards, should function properly and not have issues such as memory corruption, formatting themselves, dysfunctional analogue sticks, or buttons that stick or do not respond correctly. Controllers that do not comply should be recalled and refunds offered. Attachment accessories (such as Wiimote shells) should fit the device properly and not be prone to falling off or breaking under light force, and should be priced according to their functionality and use. A plastic tennis hoop costs less than 50p to manufacture, there is no reason why it should cost £5-£10 to the customer to purchase.

Just as any other electrical object which does not function properly would be recalled, I don't get why cheap third-party games accessories manufacturers are allowed to get away with releasing stuff that simply doesn't work properly.

@Raylax- While a great suggestion, these are more for what we should expect out of companies that release games. The 3rd party controllers and memory cards can be avoided by buying 1st party controllers and cards. However, Sony, Microsoft and Nintendo should all lower the price of their controllers to begin with. Especially Nintendo. To have a complete set of controllers with Motion Plus (Including the Wiimote and Nunchuck that came with the system) is $230 compared to $150-160 for the PS3 and 360. So in a way that could be added since they almost force you to buy 3rd party. I remember buying extra controllers for all of my systems back in the day (2600, 7800, nes and SNES) and never paying more than$20 for any of them and even that was high, but luckily the 3rd party controllers were USUALLY (not always) of the same or sometimes better quality than the originals. I know the newer tech isn't cheap but they are also making a killing on accessories. Which I guess is all part of the "Razor and Blade" business strategy.

(For those who don't know what that is, look up Razor and Blade Strategy. It's very ingenious and if you ever are in an economics/business class, the teacher will appreciate and respect the fact that you know of it)

As for the plastic shells, I'm guessing you live in the UK, but at the Dollar Tree (nothing in the store is over 1.00) here in America, they have all of the original shells (baseball, tennis, golf) for a buck each. My brother picked them up for me as a gag gift this Christmas. They also have the jackets for the remotes, but they are included now anyway (and who really likes those things anyway?).
