You should be fine. If there's something wrong with your product, all you need to do is call the company (in this case, Nintendo) and explain to them what's the issue you're having. Remember, warranty only covers product defects, not damage.

I'm not sure it's ok if it's purchased from eBay though as technically it's second hand - even though the item is brand new and sealed.
Depends on the seller. Some sellers on eBay do sell factory sealed products. If you have registered with Club Nintendo and it has been verified, then there shouldn't be any problems. You have 12 months, plus an additional 90 days before your warranty expires.
