It's honestly surprising that we only have one free theme that is based off a terrible game and only released for free because of sales. Shouldn't we get more? I know that we can buy themes, but isn't it odd that the PS3/XB360 can have a ton themes while the 3DS only have one free theme? It's really disappointing that Nintendo doesn't release free themes. Even that, we can't create our own themes with changeable audio. It's a bad business plan, if you ask me.

We will continue to be disappointed until every theme is free.
But in reality, yeah they should give out more promotional themes.. you'd think themes would be unlocked as you purchase the games they're based off of.

@Megabeedrill a few games do come with themes when you buy digital, only listing the ones I own- MH4U Gore Magala, Ultimate NES Remix Famicom, and Attack on Titan.
Though I do agree that more free themes would be splendid.

Yeah, I mean, after Nintendo demonetizes the jpeg and mp3 coupling industry what will they have left!?! It's that kind of short-sightedness that hold a great many things back. Netflix dominates the television industry by having a generous amount and quality of media available for users. Sony does so with games by having several 'free' games monthly. Meanwhile practically no one buys overpriced anime season sets. It's clear how to win in the entertainment biz and it's not to be stingy (the entrance fee is billions, mind.)
Also, you should act quickly if you want the free theme, or should I say, gotta go fast if you want to catch Sanic!
The 3DS is basically a marketing device, a POS disguised as a game console. There are so many places where Nintendo tries to get you to part with your money (not that it's that big of a problem because the stuff they make is good, but the omnipresence of it is a little stifling) I'm not defending them nor opposing them. I've bought a bunch of themes that I like from their store, that's for sure.
It does make you wonder if there was a better way around it though. Although I guess they didn't have the themes at launch, so it's semi-excusable bringing it in halfway through the 3DS's lifespan and charging money for it as optional content. If they were doing this from day one, or announced that the 3DS would have customizable sounds and backgrounds, but kept the fact that it would be only available as paid "DLC" a secret, then I can imagine there'd be more reason to be annoyed about it.
Just like Streetpass, you don't have to update Streetpass, or purchase any of the extra games, and Nintendo never walled them off from day 1, they added them later as additional content.
I get that they have a business to run and all, but you'd think they'd have more than 2 free themes.
You see, all of their financial failings since 2009 or so have been caused by that single free Sanic theme. It even reached back in time to cut a hole in their purse, you know, because when Sanic runs fast he can travel back in time (science.) A second free theme, if it at all involved time travel, could bankrupt them in the SNES era. Don't underestimate the power of the free theme.
I'm more irritated that the only free 3DS(that I remember) is Sonic Boom. People have mentioned that some themes are free for a limited time, or come with digital copies though

Several eShop games come with themes... Like Metal Gear Solid 3, Nintendogs (all three) and Nes Remix.
Some only come with themes for a limited time, though.
