I've been pondering this for a bit and I thought I would throw it at you guys to see what you think. As we all know, 3rd party games are critical in order for VC to continue(the 1st party well is already pretty dry...you can count the games nintendo still has left in the vaults on one hand). The N64 of course, more than anything other system currently supported, is CRYING out for some quality 3rd party releases.
Anyhow, it struct me that Nintendo might be able to release games from 3rd parties who are now defunct! Think about it, if Nintendo started releasing games from Acclaim, who would sue them? I can't imagine there would be legal repercussions if no one currently claims copyright on them. This would open the door to 100s more games to be released on VC!
Just because a company is no longer around doesn't mean Nintendo can steal the titles. They'd be hit with so many cease and desist lawsuits it would make Mario's hat spin. Just not going to happen.
