I called Nintendo, they stated that it's not a known fault. The guy went and checked with the manager who stated the same. He speculated that it may be a common fault but that they've not heard anythign about it.
Simply put if you have this problem contact Nintendo to make them aware of it. They did offer a free of charge repair but I've had no problem with it since the second crash.
I updated my system yesterday before using it and I haven't had any problems (yet, knock on wood). I played with all the built in software, and PilotWings Resort for about 4 hours. I wonder why some of the systems are affected , while others aren't.
Do you guys not get errors on your computers all the time?

I've gotten this once while playing Street Fighter online. Apparently it doesn't matter what game you're playing or if you're online or off. I guess it's just random? Pretty neat.
New rumour: It has something to do with your Access Point's security settings. If it's WEP, it will crash, if it's WPA/WPA2, not. Can anybody confirm/deny this?
this is completely UNTRUE. I use the highest WPA security method for internet , with this i updated the system and since then i had the error two times. So its NOT wep related !!!! my bet is still a fault with the version 1.01 firmware ... still confirmation needed
@Stereoman: Thanks for quick reply. Well then, the new firmware seems to be the only lead we have yet. We really need to find people with a new 3DS which isn't updated so we can confirm this theory. I am currently searching for these kind of people on a Dutch forum. However, the blog related to the forum mentioned the update and pushed everyone to update, so no luck so far...
I haven't had the error once since I got this Aqua Blue model on launch night (knock on wood).
You probably haven't updated it, like me. I haven't had any problems either.
I still think it's not the update. I had the 3DS without the update for 2 hours and didn't have an error. 2 hours may not be enough testing time,but I've had the update for a day 1/2 now and still no error message.(thank god) I think some 3DS may just have a defect in the firmware.

You haven't had an error message because you didn't update. The update is obviously the problem. Everyone who updated is getting that problem.

You said you had the system WITHOUT the update!! Obviously I now know you meant to say WITH the update, but typing the wrong thing will cause confusion.
