I was planning to buy/download NSMB2 tonight, but now I'm hearing games will not transfer to the 3DS XL, which I planned to go out and buy tomorrow. If that's the case, I may hold off.

t doesn't transfer your games. It only transfers system data. All your games and game saves are on your memory card. It connects to the Internet at the start and transfers your licenses from the Nintendo Eshop, then the rest of the time is spent transferring system info (slowly). When it completes, you take the memory card out of your old 3DS and put it into the new one and you're done. If you don't want to use the old memory card, you'll either need to transfer all your games and saves to your computer and then copy them to your new card and then put it into the XL, or simply re-download everything onto the new card, in which case you lose your game saves.

Well of course, that's how it's meant to work, games are on the SD card and they will remain there after the transfer, but they will be usable only on the new 3DS.
I did a transfer from a Nintendo 3DS to a Nintendo 3DS XL earlier today and everything transferred. The only things that don't transfer - which Nintendo already told us about - are photos, videos, and music.
Games are transferred, and once the system transfer is complete, you'll be asked to move the SD card from the old system to the new system. They are transferred in that sense, they are still tied to your new system, and you can still play them.
