When you’re is a position of complete market dominance you can afford to push the envelope with regard to what the market will accept.

Higher pricing is a product of Nintendo being, essentially, uncontested in the handheld console gaming market and having strong IP unavailable on any other platform. Also, having a considerable install base from 140 million switch sales tied to their ecosystem. Nintendo have a ton of market power right now and are flexing that power with respect to pricing and DRM requirements. They’re walking the tightrope of maximising their profits at the expense of consumer welfare. They’ll have run the figures and these are the decisions they believe will generate the highest returns.
