Where there's a hit, there's a writ. I don't think they'll care too much that Nintendo will win; they're probably just hoping for a nice pile of cash from an out of court settlement.
What took them so long? Wii Fit's been out for around two years and it took them this long to notice? What cave were they living in, and how deep is it?
It seems that this company is suing because of intellectual property violations since the balance board does something that their patent does. However, what their patent does is pretty much just a scale that hooks to a computer, so in essence they are trying to claim IP violations on something that most people have in their bathroom and every doctors office has been using fo a century.
Now Nintendo would be smart to team with Sony and Microsoft to countersue this company for IP violations on it's "CES Award Winning" controllers since they were unlicensed and used their (more than likely) patented method for the controllers to connect to the systems. Something tells me that if the big dogs go after this yapping chiuaua they'll go running straight for the house.

I hate patent trolls, but ever since Immersion won the haptic feedback case back in the day against Sony, I feel its a toss up whether they'll win or lose. Sadly, in part, I indirectly helped in the Immersion case because the team that was handling that came to the store I was working for at the time and purchased a ton of games with force feedback and sought my help with choosing the games. Sometimes it takes a bit of time to build a case and they also need for it to sell for awhile in order for it to appear to have a larger potential financial impact on the suing company, so the 2 years thing doesn't surprise me. Regardless, I still feel they're patent trolls though, but I wouldn't expect Nintendo to necessarily settle especially if it doesn't appear that the patent fits the description.

Yet another reason why I should leave the States; people are bat-%$#! insane about suing companies who have lots of money for no reason other than money. The only thing that's keeping me from not leaving the States is the fact that Europe and Australia usually get screwed when it comes to release dates for games.
