Is this legal? Just curious... I've heard snippets of songs here and there and I just want to know if its legal to do so on the Hatena website and on your dsi on the site.

Well, no one's been sued so far.

I think as long as you state who owns the song in the descrpition or in a frame of the animation, it should be allright.

I'm sure just like youtube, you can post videos with copyright songs, but give credit to the creators.

Also, regardless, if the copyright owners call Haneta and say take that song off, they'll more the gladly just take down your video... So no biggie.

True. Ok, cool. I asked also because I was going to start working on a new Flipnote but wanted to add mixed snippets of songs I like... Anyways, thanks for the insight! And if anyone else wants to throw in their 2 cents please go ahead...

Like they've said, it shouldn't be illegal as long as you give credit to the creators and you don't use the copyrighted material for commercial use. In this case, I doubt you could get any money from a flipnote.

Well ... technically you also need to get permission from the artist to use their work. And just giving them 'credit' isn't the same as paying royalties ... so technically you would be breaking copyright law.

The "agreement" that you agree to before posting to Hatena contains some vital info about copywritten material.

Well all, I've found an answer for you, despite flipnote being filled with videos with the likes of the simpsons, spongebob and south park used in them, you CAN'T USE copyrighted music, as I found that today mine was taken off the site

If you buy a song - download it legally and pay for it - you are entitled to listen and enjoy it. But that doesn't give you rights to reproduce it and publish it somewhere else. The copyright laws for dowloaded music are very fiddly, and they aren't always the same depending on what source you use.

The problems with using songs in Flipnotes are more than just someone else could download it for free. You have to have the artists permission to use their songs. Say you make a video putting a load of garbage in it that offends the artist. The rest of the world might think it's funny - like Tylero's great animation - but the artist might not.

And say you created something using music someone else created - even a friend's music. You upload it and suddenly it starts getting played all over the net, and then a DJ picks it up and starts playing it on the radio. The musician didn't get paid. No-one's getting paid, yet other people are listening to it, and sharing it. Another problem would be that someone else could copy the song, say it's their own, produce it and make lots of money.

I've created a Flipnote from a poem that I like ... but even there I'm not sure if I've violated copyright laws. Yes, I own the book that the poem was published in. But I don't know if I have the right to add my drawings to it, and then post in on the World Wide Web. Making it for my own benefit would probably be OK ... but sharing it might not be. It's tricky.

If you really need music make your own (Like I do) or get music from undiscovered artists who encourage this sort of thing. Triple J UnEarthed (In Australia) has thousands of unsigned artists who enjoy having their music being spread around and don't mind not getting paid for it because of the publicity.

Im sure that providing a sample of a song is no longer than a set amount of something like 30 seconds of a much larger piece of music, is of a lower quality, cannot be replaced by a public domain equivilent and it doesnt affect the sales of the original piece then it is legal to use without permision under the copyright and fair use laws so long as you have a good enough reason to. Also some things are considered open license based on the topic in question. Such as George Lucas has given permision for people to make fan films, animations etc about star wars and as such specific things such as the opening music would be allowed to be used in such works, however downloading (or recording) of the opening music to use as a ringtone would be a copyright infringement.

play the video and put my DSI up to the speakers and press record.
