They say it's being released at midnight, but in what time zone? I'm in eastern time and not trying to stay up to 3 am before even starting the download.

Seeing as Nintendo of America's headquarters is in Washington state, I would predict that the midnight they are referring to is Pacific time, meaning around 3 AM for us on the east coast. It is also worth mentioning that every time they have given a specific time for something in the past, it has been pacific time.

Generally, that means midnight across the territory. Whenever a big game has a midnight release, earlier time zones get it first, but everyone gets the game at their own midnight.

Thats what I figured. They probably go by EST since at Noon on Thursday is when they release new downloads which is 9 AM. So its probably midnight EST 9 PM PST.

Because it's digital. While regional price differences on physical copies might be legitimate due to the cost of shipping vs. population able to buy the game, it shouldn't cost more (at least to Nintendo) to sell you the game whether you live in New York or you live in Siberia.
But Nintendo's already said they think people will pay the same regardless of distribution medium.
