My D-pad sucks. Sometimes it makes crunchy sounds when pressed, it looks loose.. My 3DS may not have the lower screen rim problem, but it does have a D-pad issue. I think they should have made it like the Wii Motes or DSi. Those are my personal favorites.
Honestly, I thought that the DSi D-Pad was slightly better. It isn't too big of a deal though, seeing as most of the action will be on the circle pad anyways.

Seeing as one of the biggest reasons I bought the 3DS was for VC it's a big deal for me.
I would like to use it more to cause the circle pad controls feel too loose. I have to push the circle way to far just to make characters run and it wears out my hands. =[ So yeah.....very disappoint.
