I just returned to the home menu after visiting the eshop and some of my downloaded games mysteriously disappeared!

I like tears.

Turn the 3DS off, pull the SD card out then back in, then turn it on again. That's what I did

I can tell you from my own experience that Nintendo won't delete the games you got from club nintendo from your 3DS if your CN account gets closed.

Were they legitimately obtained games? Or were they "mysterious" downloads that Nintendo would have to look into?

I suppose for now you could try redownloading them.

This is why i HATE nintendos Draconian pathetic Download policies...if this happened on a Vita or..PS3/4..Etc..look in download history press redownload issue done. This is my #1 complaint about nintendo and the reason i refuse to give the Eshop even one penny and likely even if it's library expands will not buy a Wii-U...seriously NIntendo it's 2014 not 2000

Check in for new sheets every Monday. There's lots of Fire Emblem arrangements coming.

If you downloaded the games once in the past, I believe that should be free to download again on the Eshop.. also make sure you're even using the right SD card.

All nintendo can do is disable an account.. they can't remove/crash hacked 3DS systems and already downloaded games.. once the games have been downloaded they must be manually removed, it's not possible for them.

Although if you believe it is something with your nintendo account (I could be wrong with the above statement I just don't see how..) you can try calling them (Cya in 3 years!)

I wouldn't call it anti-customer, but it is archaic. At least nintendo recognizes that and is moving forward to change that.

Plus.. why should nintendo fix something that very very few people even complain about... atleast you can copy data onto 10 dollar SD cards instead of 50+dollar harddrives and such.. without paying for a membership (in microsoft's case anyway)

Is it possible that Nintendo now has control over games through Club Nintendo? Club Nintendo can be linked to the NNID, and games can be controlled from there. I think we ran into this possible scenario.

Club Nintendo games >>> 3DS downloads the game >>> NNID recognizes that the game was a CN game is now tied to that particular account.

I'm guessing that Nintendo took these actions.

CN account was deactivated >>> NNID recognizes the account was deactivated >>> NNID deletes games given through CN.

If this is true, then I'm not going to be very happy.

As Stomatopod17 pointed out, you can do that on 3DS as well. I don't think that's the issue here, though.
This reminds me of someone a while ago who took advantage of a free game offer multiple times when the T&Cs said one per person. (Or something like that, I don't remember all the details) Nintendo detected the suspicious activity and deleted his account, including all the games he had downloaded. Prof_Clayton hinted at this too. Nintendo do have the power to do that and, if your Club Nintendo account is also gone, I think that's what has happened here. If you haven't done anything dodgy it was probably just a mistake, and a call to Nintendo Support might fix it.
