I have an issue with this ban because there's no appeal process to speak of. You're not given any warning... they just outright ban you... and it's not like you can pay to get off said list. They're also having mistakes when detecting people if someone buys a used game. Nintendo has been against selling used games in the past citing Japanese laws to stop such things. It's a bit evil in practice. Imagine you have your Switch and one of your friends decides to pop in a MIG Switch cart to be "funny"... now your Switch 2 is dead... and you can't sell it off except for parts. And maybe not even then if they detect it using the mainboard.
XBOX has done worse (like the one story of a guy being banned because he lived in a town called Fort Gay).... but at least they undid that one. If Nintendo detects any hacking, then they're subject to a ban... seems really extreme... especially killing the resale market for the console.
